    I just received a mail from a person asking for information. Can anyone help out here?

    Kent, has anyone compliled a list of court cases against the Watchtower Bible and Tract Society, in which the society lost. Cases such as defamation of character, psychological abuse, damages from disfellowishipping etc. This will save me a great deal of research at the law library. Forward this to anyone who might have this information. Thank you

    If anyone do have a list like this, please tell me about it!

    HI Kent: Sometime back I went through all the US Supreme Court cases involving the Society, as well as many US Circuit Court, State Supreme and Appellate Court cases. For example, the Society lost a case in Los Angeles, CA decades ago regarding taxation of its stored inventory of literature supplies in LA County. The Society simply moved their storage location. I don't recall any losses at those court levels.

    Any cases they may have lost for defamation of character, liable, etc., civil liability in molestation and rape cases are likely ruled on at the Municipal, County Superior Courts, and lower State Courts. These cases are "not" generally available on line, and must be searched by letter and phone calls to each jurisdiction. There are thousands of lower courts, and the task in finding these cases is onerous.

    The best way to do this would be for someone to coordinate an ex-JW from every county in the USA to look at cases in those counties. A trip to the County Courthouse visiting the Court Clerk's office would be fairly easy. In one trip the Court could produce a database list of any cases involving the WTS, and often these are few and may show the judgment. Then a copy could be ordered, and will cost anywhere from $10 to $30 or more, depending on the size of the case file. This would take some time, but could be done. The Coordinator could keep a list of every county in each state and check them off as any reports come in.

    There will be some cases, perhaps many, where the matter was settled out of court, or where the case was sealed for some odd reason. These will remain undetermined, but the initial record will be there and should prove useful just knowing that it exist. In those cases, it will state the cause of action leading to the suit. The settlement or ruling will not be shown. Some cases will also be dismissed because the trail judge ruled it was with foundation, or that it was considered frivolus, or the Plaintiff may have dropped the suit in some cases. But even a record of these would prove useful just knowing the "scope" of actions considered.

    Ongoing cases currently in progress will be at various court levels. We have the recent Ritzville, WA trial in the criminal phase, and later could become a civil suit if the victim chooses. We have the Maine case, still being appealed by the victim to the US Supreme Court, the Berry case in NH is just filed. There is a major case going on in New Jersey, another in Colorado, I think California and a few other states.

    I will volunteer to coordinate and maintain the County data base. But I will need ex-JWs from every county, or at least an ex-JW who can access one or more counties to step up and offer to do some research. Hope this is somewhat helpful. - Amazing

    Are you referring to the REES Case, which has repeatedly been shown on this DB to be "dead as a doornail" (even Max's own words) as of February 2000?

    Hi MadApostate: I followed the Rees case for a while, and then learned that the Maine Supreme Court ruled in favor of the Society. (The Perpertrator, as I understand was convicted in the criminal phase, but this series of appeals was the civil phase, which included the Society as a co-defendant.)

    That said, I obtained the name, address, and phone number of the attorney who represented the victim. I was planning to write to him to find out if they planned an appeal to the US Appellate or Supreme Court.

    Then, subsequent to the Feb 2000, sometime earlier this year, I received a private email from a highly trusted source which led me to believe that the case was being appealed to the US Supreme Court. These appeals can take a long time before they are even assigned to the review phase to determine, by a panel of at least 3 Justices, whether they will hear the case. Since I have heard nothing contrary since then, I am still of the impression that the Rees case is still around.

    I met Maximus in August 2000 in a private email. So all this that I speak of took place since that time, which is well after the February 2000 date you mention. If you meant to write Feb 2001, then again, I have to say that some my follow-up took place after that time.

    If I am incorrect, it is no big deal. The point of Kent's post was to obtain a list of cases, primarily, those where the Society lost. But, I expanded that suggestion to make a comprehensive list of all the cases, win, lose, or OOC Settlement. If indeed the Rees case has died, and no further actions are being pursued, then so be it.

    Here is my entire list of "successfully adjudicated" U.S. tort cases against the WTS:

    First, there was Olin Moyle v. WTBTS in 1943.

    Second, uhhhhh, well I haven't found a second one yet.

    Better hold up on developing that database.

    Amazing is correct so far as indicating that there have likely been several lawsuits filed in the past, however he fails to realize that if any of such ever were actually adjudicated, then the losing party (WTS or plaintiff) would have appealed such to a higher court, whose decision would likely be available on internet accessible records.

    Aren't many cases such as the ones described, when successfully prosecuted have an inclusive 'gag-order' in order to recover the monetary judgement? Tina
