    Good Morning all and Happy Sunday!!

    I just posted this on another thread, but I think the thread is pretty well done. So I thought I would start a new thread with this thought. Wan't the "Big Announcement" supposed to happen on Oct. 16th?? Well to my knowledege, there WAS no big announcement....or WAS THERE after all?? Maybe the announcement was not coming from the Borg, but that they knew the ruling was going to go against them, and decided to prepare for it. Could that be why the tract came out and hyped all the JWs up?? Take a look at the date on the bottom of this court ruling..Thanks to Pseodeo..we now have the typed document:

    Plaintiffs’ Motions To Compel Discovery came on for hearing on October 13, 2006. The

    court, having read and considered the papers in support of and in opposition to the motion and

    having heard oral argument, took the motions under submission and now rules as follows:

    Plaintiffs’ Motion to Compel Depositions and/or Protective Order re: the Woodland
    Elders (Motion #1)

    The Watchtower defendants have informed the plaintiffs that, at the depositions of four

    Church Elders, they will invoke the clergy-penitent privilege and object to "any inquiries

    concerning judicial investigations and judicial committees." Plaintiffs seek and order compelling

    the deponents to attend their depositions and to respond to such inquiries.

    This court has previously ruled in the Track 1 cases that the penitential communication

    privilege does not apply to communications between the alleged abusers and the Judicial

    Committee. (See Court’s ruling of September 29, 2005.) Although that ruling is not res judicata

    in non-track 1 cases, defendants provide no convincing reason why the court should rule

    differently in this case. For the reasons expressed in the earlier ruling, the court concludes that

    the witnesses may not assert the penitential communication privilege. To the extent the motion

    also encompasses the production of documents, defendants shall produce responsive documents,

    regardless of when they are dated. As plaintiffs note, it is possible that documents dated after the

    alleged abuse will contain relevant information. For these reasons, plaintiffs’ motion #1 is

    GRANTED.

    Plaintiffs’ Motion to Compel PMK Deposition and Documents - General
    (Motion #2)

    Plaintiffs have noticed the deposition of the Church defendants’ Person(s) Most

    Knowledgeable (PMK) on a number of specified topics. Defendants have objected to six areas

    of inquiry, again invoking the clergy-penitent privilege. For the reasons discussed above and in

    the court’s earlier ruling, the court finds that the clergy-penitent privilege does not apply to these

    documents that post-date the alleged abuse are not relevant or likely to lead to the discovery of

    admissible evidence. As above, the court finds that the documents are discoverable. For these

    reasons, plaintiffs’ motion #2 is GRANTED.

    Plaintiff’s Motion to Compel PMK Deposition and Documents - Legal
    (Motion #3)

    Plaintiffs previously issued a PMK deposition notice concerning "any and all policies that

    the Jehovah’s Witnesses organization had for handling accusations and proof of child sexual

    abuse from 1970 to the present." During that PMK deposition of Mr. Breaux, he identified

    functions that were handled by the Legal Department rather than by the Service Department,

    where he worked. As to these, he lacked the information necessary to provide responses.

    Plaintiffs subsequently noticed a PMK deposition to inquire into (1) the organization,

    staffing and operation of the Legal Department; (2) the Legal Department’s role in responding to

    and investigating child sexual abuse allegations within the organization; (3) the development and

    use of "Child Abuse Telememos" which were forms developed to obtain and record information

    concerning reports of abuse (blank forms were produced in discovery); (4) records kept by or

    under the direction of the Legal Department concerning allegations of abuse; and (5) answers

    given to "survey questions" contained on one of the Telememos.

    Defendants have objected that these areas of inquiry are protected by the attorney-client

    and/or work product privileges. As to the first two categories, plaintiffs contend that they

    concern only policies and implementation, and do not invade any privileges. As to categories 3

    and 5, they assert only that the requested information is related to the blank documents they

    already received in discovery, and that the information goes to the blank documents they

    already received in discovery, and that the information goes to the heart of their case. Finally, as

    to category 4, they claim again, that no privileges would be invaded, because they seek general

    information about the types of records kept by the legal department.

    The court agrees that items 1, 2 and 4, which seek general structural, policy and

    organizational information concerning the Legal Department, implicate neither the attorney-

    client nor the work product privileges. Items 3 and 5, on the other hand, seek protected

    information. As set forth in the declaration of the Church’s associate general counsel, the

    Telememo forms are completed by attorneys or legal assistants based upon information provide

    them by congregation elders, and are used to assis in giving legal advice to the elders, as clients

    of the Legal Department. Similarly, any compilation of information, as from the "survey

    questions" constitutes attorney work product and is not discoverable.

    For these reasons, the court will GRANT the motion as to items 1, 2 and 4 and will

    DENY the motion as to items 3 and 5.

    Special Campaign October 16-November 12!


    1. “The End of False Religion Is Near!” That is the titles of the Kingdom News No. 37, which will be distributed around the world beginning next month. During the first half of October, we will offer the Watchtower and Awake! magazines. Starting Monday, October 16th, through Sunday, November 12, we will engage in an intensive distribution of Kingdom News No. 37. On weekends during the campaign, we will offer it along with the current magazines.

    2. Who Can Share: All who are actively publishing the good news will want to have a full share. Some will be able to auxiliary pioneer. Do you have children or Bible students who are making spiritual progress? Help them to approach the elders to see if they qualify as unbaptized publishers. Elders should take the initiative to speak with inactive publishers in order to encourage them to participate, perhaps, by working along with experienced publishers.

    3. A supply of Kingdom News No.7 is being sent to all congregations so that publisher and pioneers can obtain at least 50 copies. Interested ones who are not yet publishers may receive five copies to distribute to family members and friends. All should keep track of the number they place and note this on the back of their field service reports at the end of October and November. The secretary will tabulate the totals for the congregation and report it to the branch office at the end of each month. Any copies of the Kingdom News that are remaining after the campaign concludes may be used in any feature of the ministry.

    4. What to Say: Keep you presentation brief, as this will allow for a wider distribution of the message. You could say: “As a public service, I am sharing in an earth-wide distribution of this important message. This is your free copy. Please read it.” Be sure to keep a record of the interest found.

    5. How to Cover Your Territory: Rather then distribution the Kingdom News in the street work, focus on covering as much of your house-to-house and business territory as much as possible. Keep track of not-at-homes, and try to return at a different time or day of the week. Beginning Monday November 6, a copy may be left at not-at-homes. However, if the congregation has more territory than can be covered during the allotted time, the elders may determine that the Kingdom News should be left at not-at-homes during the entire campaign.

    6. The destruction of “Babylon the Great” is fast approaching. People need to get out of her before she is completely destroyed. (Rev. 14:8; 18:8) Make plans now to have a full share in this worldwide campaign to let all know that the end of false religion is near!

    I really don't know how to answer your question. It could be. I just hope this decision hits them where it hurts. It is deplorable how they denounce other religions i.e. R. Catholics and their pedophile issues and then try to cover their own asses. Two witness rule - what a crock!

    Nothing is worse to me than crimes against children. The WT authorities should all be hung by their cajones and then taking peoples' hard earned money for the worldwide work fund to spend it on fighting for the rights of clergy/member confidentiality.

    There is no way the WTS could have predicted the decision of the courts months in advance before the issue was even placed before the court.

    I thought it would be funny to print this out and when JW's come to your door. Point to the section that was about church leaders being immoral and read that too them and follow up with the print out. Although, the way we got our tract was from someone leaving it under our door mat.

    I agree. But wouldn't they have had an idea before the ruling which way it may or most likely go? I don't know.. just a thought..and you have to admit it is very strange both came out on the same day. Even if this wasn't the big announcement. Things that make you go Hmmmmmmmm.

    You DO KNOW, dontcha?........that if we were to keep copies handy of these court orders and legal judgments against the WTS and the copy of the UN's website which deals with the WTS affiliation as an NGO and "place" these copies with any jdubya that approaches us, whether in field service in our homes or on the street, etc., it might just help in opening the eyes of the "fleeced ones" and cut down on field service and preaching. :)
