These comments are from the JW.org website and it's clear from this that they think they are above the law

The court of appeals acknowledged that even if the woman felt distress because former acquaintances chose not to converse with her, "permitting her to recover for intangible or emotional injuries would unconstitutionally restrict the Jehovah's Witnesses free exercise of religion . . . The constitutional guarantee of the free exercise of religion requires that society tolerate the type of harms suffered by [her] as a price well worth paying to safeguard the right of religious difference that all citizens enjoy." This decision has, in a sense, received even more weight since it was handed down. How so? The woman later petitioned the highest court in the land to hear the case and possibly overturn the decision against her. But in November 1987, the United States Supreme Court refused to do so.

Hence, this important case determined that a disfellowshipped or disassociated person cannot recover damages from Jehovah's Witnesses in a court of law for being shunned. ^ Since the congregation was responding to the perfect directions that all of us can read in God's Word and applying it, the person is feeling a loss brought on by his or her own actions.

    Utter Crappppppppppp

It's all about damage limitation. Shut those up who know the truth and make sure they can't sue.

    The lawyers run the watchtower.

You've got to bear in mind Religion receives big protection in the US courtesy of the Constitution and it's Amemndments. I'd like to see it challenged in a less' protected' arena though.

I think there are still several aspects that can be attacked in a lawsuit:

    1. Religious groups aren't immune from libel and slander laws or from laws preventing invasion of privacy.

I have read of churches being successfully sued for announcing that a member is no longer in good standing because they committed adultery, for example.

    2. The WTS also has written procedures designed to protect accused JWs (Two or three witnesses; notice to the accused; elders on the JC not having a bias, etc.). If they violate their own procedures, the JW isn't complaining about the WT religion; he or she is complaining that the religion isn't following their own stated rules.

    3. The real problem for the WTS isn't with the lawsuits themselves; it's with the bad publicity it brings the organization.

I wonder whether Russia could have used that in their efforts to remove the Watchtower Organization from their nation???

I agree with DING's no.1 point. I had my DFing overturned as there was NO evidence of wrongdoing and I threatened the elders and WT society with a lawsuit for slander and defamation of character if they DFed me on unjust charges. Bethel legal department told the elders to drop my DF charges and I won my appeal. The WT society doesn't ALWAYS win
