The State has a vital interest in ensuring that children are protected “so that a new cohort of well-rounded, healthy and educated citizens can come to maturity and are thus given every opportunity to develop in life”.
However, the right of the State to intervene and thus to override the constitutional right of the parents is expressly circumscribed by the Constitution. The circumstances must be “exceptional” and the intervention proportionate to the circumstances."

Family law varies by state to state. It is not a federal matter unless someone is on federal property or in the military. I don't know of a single court that would not order a blood transfusion for a minor child. Knowing this, I fear parents may sprint their children away from the authorities. Perhaps, JW parents welcome this intervention. They still have their child and their KH friends. The only area where I see some debate is for older teens. Maybe someone that a court earlier ruled was an emancipated minor.
I told my mom when she signed no blood for my younger sister that I would call a judge from the pay phone in the hospital. One day I was at Mt. Sinai in NY where some nurses were registering a teen. The mother put up quite a fuss about how her daughter could get no blood. Unfortunately, it was a public area before HIPPA. She sullied Witnesses reputation. The nurses were steaming and rolling their eyes in total disgust. I offered my viewpoint - you know a judge will sign her away. All this drama when you have no right.
Children die for their parents' gross negligence. Government intrusion is merited. What is a Moslem beat his child to death by stoning? Should the moslem walk away?
