    Q:How do I obtain a copy of the audio recording for a case that was heard?
    A:

    All proceedings of the Magistrates’ Court are recorded. If you wish to obtain a copy of the recordings you will need to contact the relevant Court and speak to the Registrar of that Court. The Magistrates’ Court retains all recordings for a period of 12 months from the date of hearing. If a party to the proceeding (or any other person or organisation who has received special permission) has requested the recording, they are retained for a period of 2 years from the date of hearing.

    Only parties to the proceedings, being the defendant, Police Informant, Complainant, Plaintiff, Respondent, Applicant and their legal representative, are permitted to obtain a copy of the recording. If any other party wishes to obtain a copy of the recording, a written request is to be forwarded for consideration by the Chief Magistrate. Such request should be addressed to the Manager, Magistrates’ Support Services at the Melbourne Magistrates’ Court.

    A copy of the recording maybe obtained for a fee of $55.00 per case, per day. For example, if you have two matters listed and they run for one day, the fee will be $110.00. Court staff endeavour to attend to all audio copy requests expeditiously, however you will have to contact the relevant court to ascertain how long it will take to fulfil your request.

    The Magistrates’ Court does not provide transcripts of court proceedings. Agencies providing transcript services can be found in the Yellow Pages Telephone Directory under 'Court Reporting Services'.

    Is each defendant and charge considered a separate "case"? If so, you're talking $1925.00. If each defendent (with all its charges) is considered one "case" then you're talking $275.00. These are per day charges. So if you want the full set of recordings we've already had three days in court with at least one more to come and hopefully more.

    We're running into serious money here.

    Since people involved with the case can get the recordings for free, I think we would be better off hoping Mr. Unthank is one day willing to share them, or at least transcripts of them.

    I would definitely be interested in this and would be more than willing to chip in, if we can find out how much money is involved.

    No trial has occurred. It seems as though motions are being made. This case seems to both civil and criminal so it confuses me. I expect there is a record showing the appearances of lawyers. It will be good to have a transcript from a trial. Perhaps this case isn't ripe enough for a transcript. Unthank's lawyer or Unthank himself has the information. There must be some way to convince him of our great interest and deep support for his cause. Most lawyers call one of the lawyers on the record and ask for a photocopy.

    It might be possible to get a record from the Witness lawyers. Less likely than from a normal lawyer but worth an effort. If someone poses as an interested, active Witness, what is it to them?

    So far they are dealing with procedural and not substantive issues. One key move before a trial will be for a court to decide whether if everything Unthank alleges is true is there a legal cause of action? They are prob. moving mostly on paper rather than oral arguments in court. It will be great if the professional prosecutor takes over the case for a trial. I wonder if he does if the Society will cop a plea or negotiate a favorable settlement to limit their damages exposure. Their present compliance makes the case less compelling. But would they have ever complied without this lawsuit?

    Many of these points have been previously addressed. The case is criminal, not civil. I doubt whether anything would have been taped to date because they are only mentions, an administrative process. Unthank has no lawyer: he has been the prosecutor so far. The WT law firm, Vincent Toole Solicitors, is headed by Vin Toole, who lives and works at Bethel. It is most unikely he would cooperate with any outside request.
