In an ongoing dispute with his neighbor, Michael Vilkin, over a privacy hedge the dispute ended with Vilkin shooting Upton first in the stomach and then in the head. Vilkin is claiming self-defense. Vilkin did have a gun with him while doing his gardening, Vilkin claims that Upton came out of his house with a gun and fearing for his safety shot Upton in the stomach, Upton did not die from the shot but kept advancing toward Vilkin, Vilkin then aimed for the head. John Upton's mother had just died a few hours earlier from cancer.
