They should be made to change the name of the product. That is false advertising.

Yes, they're making a false claim if they assert that a thin teflon coating (pioneered by Gore-tex) is "nanotechnology."

I'm a fairly confident guy, but even I don't want to be walking around advertising that I have nanotechnology in my pants!~
ps. what's really funny about this is, I recently read an in depth study on the best raingear, and it turns out that gore-tex, while a good product, doesn't really do it's water resistant magic with the teflon coating.. in fact, for the rain gear, it (the patented coating) almost becomes superflous. I'm sure as a stain guard, it works fine.

nanotechnology is not just microscopic robots but also modelled surface structures that can repel water or the famous carbon nanotubes etc.
so perhaps they really have some shred of nanotechnology in these pants
