    Residents protest freed sex offender in neighborhood

    Parents, students, city leaders demonstrate outside school, demand Cary Verse leave

    OAKLAND -- Freed sex offender Cary Verse was again the subject of angry protests Friday after he resurfaced at a new address directly across the street from a Fruitvale district school.

    Only one day after Verse moved to a transitional home run by Benedictine monks on E. 12th Street, about 100 parents, students and city leaders demonstrated outside Ascend K-8 school and demanded that Verse leave.

    "We cannot afford to have him here," parent Emma Paulino said Friday. "Whatever we need to do (to get rid of Verse), we'll do it."

    Verse, 33, has been deemed a sexually violent predator, and is only the second person with that designation to be released in California. He was bounced from his first post-prison home in Marin County following protests by neighbors, and landed last month at a transient hotel in downtown Oakland. Word of Verse's latest move spread Friday when Oakland police gave school officials fliers bearing Verse's mug shot and new address.

    "I don't want to see the guy homeless," said Oakland Police Chief Richard Word, standing outside the school Friday. "But ... across the street from a school? In light of his committed offense, it doesn't make sense."

    Word and City Council President Ignacio De La Fuente (San Antonio-Fruitvale) spoke to Verse at his new residence Friday. Both Word and De La Fuente said Verse should move to Contra Costa County, where he was convicted. Oakland already has its hands full with ex-cons, they said.

    De La Fuente told the crowd of parents and students Verse would be gone in 48 hours. "If not, the whole (transitional home) will be in jeopardy," he warned.

    Father Donald Weeks, who runs the transitional home, said it would probably take several more days for Verse to move.

    Weeks said parents were overreacting to Verse's presence. Verse has paid his debt to society and is not a danger, Weeks said.

    "He can't sleep on the street, so we offered him the hospitality of the church," he said.

    Weeks said Verse did not want to talk to reporters because of a gag order issued by a judge.

    But Weeks did allow reporters into Verse's small apartment, which directly overlooks Ascend school. The building has libraries, church pews and an alter, and living space for 30 men who are ex-cons or struggling with drug or alcohol problems.

    When asked what Verse was doing Friday as parents protested outside, Weeks said Verse, a self-proclaimed Jehovah's Witness, was reading the Bible.

    Parents are afraid Verse will "jump out of the window like Dracula or something, and he's not going to do that," Weeks said.

    At least one other man living in the building is a registered sex offender, Weeks told reporters.

    "We have nothing to hide," Weeks said. "All we're trying to do is be Christian people and do the right thing."

    Verse has been called one of the most closely-monitored sex offenders in the nation.

    He is hooked up to a Global Positioning System (GPS), and cannot go more than 100 feet away from a device in his room without setting off alarms, Weeks said.

    Verse is monitored around the clock and is subject to spot checks by authorities. Also, Verse takes "chemical castration" drugs to blunt his sex drive. All men convicted of two serious sex offenses in California are required to take such drugs.

    "There are 19 other high risk (sex) offenders (in Oakland) who are not supervised at all," said Oakland police Lt. Mike Yoell, commander of the Oakland police youth services division.

    "This guy has a GPS device, he's chemically castrated and he's monitored 24 hours a day," Yoell said. "He hasn't caused one iota of a problem since he's been in Oakland."

    Verse has been convicted three times for sex offenses, starting at age 17 when he fondled a male teammate on his high school track team at knife point.

    It is apparently legal for Verse to live near a school because he is not on probation or parole, and has not been convicted of molesting children.

    But parents and politicians say they want him gone, no matter what.

    "We don't care where you take him as long as you take him," De La Fuente said.

    The council president said he got a call about Verse living across from Ascend school Friday morning, and immediately rode his Harley Davidson motorcycle to the building.

    When De La Fuente got there, he "screamed and hollered at me," Weeks said. "He even shoved me around a little bit."

    De La Fuente denied shoving the elderly monk, saying "that's not true. But I can tell you, I was not happy.

    "I told Cary Verse to his face that there's no way I was going to allow him to live across the street from a school," De La Fuente added.

    City officials also have launched a legal offensive, taking their frustration over Verse's placement in Oakland to court by petitioning a Contra Costa County Superior Court judge for the right to have a say on where he should live.

    Earlier this week, the City Attorney's Office argued in Martinez that Oakland should be heard on the issue because local taxpayers are footing part of the bill to monitor the sexually violent predator.

    "Our obligations and the security of our citizens mandate the formal recognition of the city's undeniable interests in this matter," attorneys for the city said in court papers.

    The Alameda County District Attorney's Office has made a similar request.

    But officials from the Contra Costa County Public Defender's Office and the state Department of Mental Health, which oversees Verse's release, are opposing Oakland's petition.

    The 1996 Sexually Violent Predator Act does not provide cities a voice in where predators live when they're released from Atascadero State Hospital, argue attorneys from the state Attorney General's Office, which is representing the mental health department.

    If cities enjoyed such rights, it would throw a wrench into the entire placement process, because few, if any, communities would welcome men such as Verse, said Deputy Attorney General Susan King.

    "Everything would be slowed down if you have to listen to every potential community that he may be sent to," King said.

    A decision from Judge John Minney is expected soon.

    Oakland City Attorney John Russo said he may look to the Legislature to amend the law if Oakland's petition is denied.

    "State law is abysmal with respect to the rights of communities," Russo said. "We at least deserve the right of consultation."

    Meanwhile, Verse will again be looking for a new place to live.

    "We understand he's a human being," said parent Paulino. "He needs a place to go. But this is not the place."

    Apparently this "self-proclaimed Jehovah's Witness" hooked up to a GPS that sets off an alarm if he goes more than 100 feet from his room, is going to have to forego going door-to-door. Or is he? Is he permitted to attend "church functions" if he is under the supervision of a minister from his "church"? Can his GPS be disabled in these circumstances?

    As far as chemical castration goes, who's making sure that he's taking his meds?

    People need answers to questions like that.

    Why go through all the tax-payer expense of monitoring him for the rest of his life or however long his probationary period is? Why not just lock him up and throw away the key?

    "Chemical castration" uses injected drugs like Depo-Provera to reduce testosterone, so I would bet that the program requires someone else to administer the injection. When Depo-Provera is used as a female contraceptive, it's injected four times a year, but I have found references that state that this sort of treatment would be once a week (or as directed by the physician). I even found one reference to a man being injected in the testicles, but this does not seem to be mandated (www.eunuch.org is interesting, but I shan't be going back there...)

    Verse's petition was granted Jan. 24 over the objections of the Contra Costa County prosecutor, Atascadero and state Department of Mental Health officials.

    "The department does not believe that he is ready for conditional release," DMH spokeswoman Nora Romero said. She refused to elaborate, citing patient confidentiality.

    But prosecutor Brian Haynes said one of the hospital's remaining concerns was the conflict between Verse's homosexual acts and his Jehovah's Witness faith.

    "ASH believes there's more for him to do," Haynes said. "They said he still has some conflicts with his religion and his sexual orientation."

    did you make up that pamplet or did someone else? and I think that is a fantastic idea putting them all around a neigbour hood where a sexual predator lives. I have a sad story to tell, my best friend of many many years (we are no longer friends), her son was as a youngster different from most young chaps his age. I always suspected that someday this young man her son would become a homosexual. Because of his behaviour and mannerisms. Well I was right he is and a few years ago, he molested a five year old boy in the basement of the new home they had just bought. This young boy of five and his parents were at my friends home enjoying a meal and it was their way of thanking this couple for helping them move into their new place. Well my then friends son, was down stairs suposing to be watching Television, they were alone down stairs. Then everyone heard the young boy screaming running up the stairs, well the parents and my friends were trying to understand what the little fellow was saying. He told his father in the bathroom (as that is where his dad took him to talk to him )that so and so took me to the toilet and he put his penis in me and he hurt me daddy. Well let me tell you the shit hit the fan. The father ran and told his wife they were leaving immediatley and he told my friends that their son just molested their boy. Well my friends couldn't belive it, they said he has to be mistaken, they said their son would never ever do anything like that especailly since we are Jehovah's Witnesses. Well to shorten my story the son of my friends, this son whom I knew since he was two years old was indeed a homosexual predator a deviant. He at first denied it up and down, however forensic science proved that their was semen on these little panties and he had penetrated the little defenseless boy. My friends believed their son to be innocent but when the DNA came back he was guilty. Now the problem was he, the son was just shy of his 18th birthday, just under the age for being charged as an adult, his ass was covered by the young offenders act. Well needless to say that their son was 100 percent responsible he was still in denial, they took him away and put him in a home for young offenders some place in Orilla. He was there for a year, when finished he was on probation. Be deal eh? Made me sick what he got away with. This little boy was so badly tramatized by all this that my friends of course lost them as friends. I tried to remain friends to them however the wife called me and accused my son of also being a homosexual, because their son and my son were the best buddies since young childhood. My son is not a homosexual, but had he been he is still my son and I would except that. But not if he ever hurt anyone. I'd kill him. You know what i mean. But I would never accept him if he ever hurt or defiled anyone. My then girlfriend ended up a basket case, my son was livid with them and their son told them that my boy was not a homosexual, he was straight as an arrow. He even told that to the police and the judge and court. Because they were the best of buds the police needed to speak with my son. It was quite an ordeal all around. Our friendship became strained as I could not understand why the boys parents weren't phazed by what their kid did to this little five yr old. and maybe to other kids too. That is another story. I could kick myself today as this son of theirs is still living at home and there are children everywhere around them. My girlfriend begged me not to ever tell anyone about what had happened. Sometimes I wonder if I did the right thing by being quiet as I believe that every parent in the neighbourhood should be told. But he was protected by the young offenders act. But the little boy who by now is around 12 or so was and is never going to be the same, his innocense was taken from him. And I believe that a neighbourhood has everyright to know if a sexual predator is in the area. I have battled this for several years. My son and their son still are on speaking terms and my son says he will always consider him as a bud, but I don't understand that, because of what he did. Maybe my son is more forgiving than me. But as far as I am concerned my friends should have informed the community. Or the authorities should send out alerts letting people know. People need to know, who will protect the children if we don't take the law sometimes into our own hands. I hate and deplore the young offenders act and I wish it would be abolished. But thus far nothing has changed and still this little sex pervert lives in our town. It makes me sick.

    well I thought I had to tell someone this story as people knew in the neighbourhood they were JWS but now the family isn't any more witnesses, They drifted away, as the congregation friends stopped coming around, so I figure some one spilled the beans in the cong. and only the elders knew as far as I know. But it is a tragic story and there are too many stories like this, we need to keep our children innocent and protect them. Anyway there is no hope for their son as he lives with them but takes off to Torontos gay scene regualry and has been arrested for drugs and god knows what else. But not enough to put him away.. I am not condemning homosexuals, I condemn any who destroy the lives of others. And if this offends anyone I am sorry about that is how I feel and I needed to tell it to someone. Children need to be protected. And for some reason the law doesn't give a dam, its people who investigate and find out who is in the area and then send out alerts. But not in this case as he was protected by the law and that is a perversity because that little kid will grow up more that likely messed up.
