Okay this is a thread on church vs state. Several topics has hit at once. Lets mix and match.
Disfellowshiping is generally being kicked out of JWs. Disassociation is mostly people leaving JWs. The unofficial "shunning" attributed to being DFed has lead some to suicide. Pedophiles are disfellowshiped rather promptly providing there is evidence any pedophile that "got away with it" because their were not two-witnesses got away due to cunning (not the WTS fault) or negligence on behalf of the elders(the fault of the actual elder), for the WTS says you can disfellowship a person with only circumstantial evidence.
For example if a woman was raped and the offender left semen the local Kingdom Hall only has Sherlock Holmes era forensics, investigation and interrogation techniques, but the court has access to the latest technology to prove guilt. If the rapist is found guilty by law, but tried to cover their guilt with the brothers they will be DFed. When things are left up to Jehovah it is saying that we don?t have the capability to gather all the evidence and hopefully another person will be inspired to come forth, but this is the same thing law enforcement says anytime a fugative is on the loose. It would be truly unchristian to disfellowship a person for being only accused. Imagine you are in a divorce your ex accuses you of molesting a child since this is pornia they can remarry. Very conclusive evidence will be needed just like in the real word.
How can people ethically call a policy such as DFing inhumane for everyone except pedophiles? Also the Jehovah's Witnesses is a church, and like all churches they deal with their respective God and this is their concern, and not the law. Therefore basically their Jurisdiction is confined to the offender?s spiritual welfare. So if a person admitted they are a pedophile the and the elders acknowledge this, but does not disfellowship the person it is not making the elders liable for anything, for their judicial ruling is a spiritual ruling and not a civil one.
If you are disfellowshiped it is effectively increasing the guilty parties chance of divine retribution which may be eternal capital punishment. While this is a may be a fairy tale to most at least eh JWs add real world, real time consequences some people label "shunning". If the shunning can cause a pedophile for example to commit suicide or turn themselves into the authorities how can such a system be immoral? Consider that the maximum sentence for child abuse is 10 years in which they have to let the criminal go regardless of if they are repentant or if they still intend to molest again. You can remain disfellowshiped indefinitely and only be reinstated if you repent and cease at any attempt to be secluded with a child. It seems that the disfellowshiping principle is a just one; considering it is the only way to control negative behavior passively with out violence or breaking the law. Considering how the state handles crime the only difference is the "punishment" and advanced techniques used to gain circumstantial evidence. If the government could figure out how to get everyone to go along with it they would DF people too.
