    DOCTOR CLEARED IN DEATH

A B.C. Supreme Court judge has determined a release form signed by a local Jehovah's Witnes woman who died following a hysterectomy is enough to clear the doctor in the case from paying damages...........

btw. the reporters name is Mike Chouinard at [email protected]

According to Zivot, the judge must determine whether release forms that remove responsibility from the physician might actually result in lesser care for Jehovah's Witness patients, and are therefore a violation of their Charter rights. He is not sure when this matter will go back to court.

This is interesting. Keep us posted on the final decision.

My (nonJW) daughter's boyfriend (JW) and his mom tried to tell her that not accepting blood transfusions meant that you would get better care because the doctor's would be "more careful". I pointed out that the opposite could also be true...I'll have to show them this article.

As scully has pointed out in the other thread, if doctors are NOT absolved from responsibility, the JW's may not have to worry about lesser care. They can worry about finding a doctor who will take them at all.

This is one to watch - I feel this is one that can have significant consequences whichever way things go - because there will be an appeal I am sure
