EDMONTON - Alberta is changing the rules to give victims of sexual and domestic violence more time to sue their abusers in civil court.
Justice Minister Kathleen Ganley introduced legislation Tuesday that will end the current two-year time limit on filing lawsuits to recover lost wages and other expenses, or for pain and suffering.
Instead, there will be no time limit on filing a lawsuit, and the legislation will be retroactive.
“The decision to come forward is extremely personal and can be very difficult,” Ganley said at a news conference at the Sexual Assault Centre of Edmonton before the introduction of Bill 2.
“Survivors of sexual and domestic violence should be empowered to come forward on their own terms.
“They should not be forced to come forward on the basis of a deadline imposed by the legal system.”
The new rules will apply to sexual assault and sexual misconduct, as well as assault on children, dependents and partners. Sexual misconduct includes stalking or sending inappropriate text messages or photos.
The former two-year limitation normally begins when the assault occurs.
Debra Tomlinson, chief executive of the Association of Alberta Sexual Assault Services, said the civil action will “help lift that veil of silence” on violence.
“It gives survivors the time they need to recover and heal from the effects of sexual assault trauma,” said Tomlinson.
The civil process is independent of the judicial one. In a civil case, a judge rules on the balance of probabilities rather than on guilt beyond a reasonable doubt.
Ganley said Alberta is the first jurisdiction to exempt sexual misconduct lawsuits from the time limit. Changes to the time limit on sexual assault will bring Alberta in line with most of the rest of Canada, she added.
Mary Jane James, executive director of the Sexual Assault Centre of Edmonton, said civil action is a vital option given the high standard set in the criminal system.
“Because the burden of proof is so high in the criminal justice system, a very small fraction of (assault) survivors will ever see the inside of a courtroom,” said James.
“For survivors to be able to pursue a civil claim at a time when they are ready to do so and where the burden of proof is significantly less onerous is a change that is truly representative of a government that gets it.
“When survivors are believed, listened to and supported, they can reclaim the life they had before the assault, a life that they most definitely deserve to have again.”
back in 2005, i remember sitting in the stadium in the special rows with 42 others.
8000 people were looking at us - maybe even with a binocular - while listening to the speech.
my family and my friends among them, being all proud of me.. i don't remember being enthusiastic.
Our child was baptized several years ago. Upon coming up from the water, there was a distinct look of shocked confusion upon his/her face. I mentioned this to him/her last year, and received the reply "You noticed that?"
Yes, he/she was expecting some superpower to land, and to miraculously change his/her life.
Nope.
(I remember noticing no difference at my own baptism, but also was not expecting the same level of miracle effect.)
i've been as honest as i can on this forum throughout my time bouncing in and out..and been jumped on for saying anything positive about the "truth" or my experiences at the hall, but it's been a few years now since i have been attending meetings.
i go to the memorial for family reasons and went to the assembly today for the same reason...but one observation i have to make is most of us have all dealt with years of hearing how gawd awful "the world" is and how the only happiness is going to meetings and out in service.
now that is total bs.
Ummm, go watch a good movie.
https://www.jw.org/en/publications/books/convention-program-2017/friday/.
why would our beloved gb member be on the top picture of the program?.
any ideas?.
If there is applause when ToMo makes his stage appearance, a sprinkling of awake attenders should try to generate a standing ovation, and chant: "Tony, Tony ... "
has this question ever been answered by wt or biblical apologetic?.
if near the beginning of her creation, would she not have had the effective development of a a toddler or even a baby?.
if so, would you sentence a toddler or a baby to death for grabbing an appealing candy from a bowl?.
Why don't they have a drama on this story? It might get more attendance than any memorial ever got.
Full frontal.
Paid admission only.
i have a relative who is a "dyed in the wool true blue jw" and yesterday he sent me this link with the jw method of evaluating the news " more to come !.
sounds like they're grasping at straws now to put meat on their failed prophecy bones.. http://www.freep.com/story/money/business/michigan/2017/02/23/family-christian-stores-close/98310234/.
The entire world is getting kudos for helping this one and helping that one....young people helping one another, folks travelling all over the world to help others and the media is picking it up....so what about witnesses...as you now many need validation...(that's why they report whatever they do)...and so because they are attention hogs, even if they act like they aren't they are....JW's are wondering...what are we doing? Everyone in the world is trying to help, but what are we doing...just handing out paper...
At so many meetings, the line about really helping people is used. "If you really want to help people, you do not give time or money to charity, you go in the ministry."
Looking this nonsense up in old WT's, they actually linked helping charity to this (WT Aug 15, 1960, p 488):
What are we to think, then, about what is popularly called the “social gospel”? Is reforming the world the work of Christians? There is no doubt that much time could be spent on efforts toward social reform. Some persons, for instance, might spend their whole lives combating some vice such as gambling, prostitution or alcoholism. Trying to clean up the world’s entertainments, movies, books and magazines, could consume our life energies. What great energies could be expended fighting poverty and delinquency! Seeing the world in a frightful mess, the Christian wonders: How can I do the most good?
...Why did Paul refuse to waste precious time on the “social gospel”? Because he knew that Jehovah God through his kingdom in the hands of Jesus Christ would blot out economic, industrial and social slavery at the war of Armageddon
...
To try to bring about this result by any other way will not only fail but be out of harmony with the will of God. God is not going to reform this world; he is going to destroy it. This evil world is not a friend of God; “whoever, therefore, wants to be a friend of the world is constituting himself an enemy of God.” (Jas. 4:4) To join in with this world’s programs of reform, preaching the “social gospel” instead of the Kingdom good news, places one at enmity with God.
i was pondering the recent influx of lawsuits against wt, specifically in regards to the child abuse cases (ie.
conti, fessler, lopez, etc).. in each of these, wt has settled for an "undisclosed" amount, assumed to be in the millions of dollars each.
i know there are many many more cases, subject for a different thread i'm sure.. i was reading something completely unrelated a while back that mentioned the dangers of settlement agreements for a large corporation or business (not just wt).
Phooey.
Is that you, Dad?
(I haven't heard that word in a coon's age.)
