OK, let's break this down....
- WTS states that they do not have "jurisdiction" over California.
- The WTS claims penitential privilege in refusing to turn over "penitential communications" to the plantiffs.
And here is what the court found:
Regarding item #1 above - The WTS materially engages in three primary activities in the state of CA. These three activities are, the Kingdom Hall Fund, the Kingdom Hall Assistance Arrangement, and the acquisition and sale of real property. The KH Fund is a program that provides loans on KH property. The mortgages are secured through the financed property. Also, the WTS charges interest on these loans.(Deut. 23:19)
The KHAA is an insurance program designed to help cover substantial losses to KH's. Although this program is termed "voluntary," ALL California KH's use this program. The congregations are sent invoices to pay their "contributions." The court characterized the collection of this money "as insurance premiums, regardless of how they are labeled by the defendant."
The WTS has also received a substantial amount of monetary gain through the acquisition of real property. Many witnesses have donated their estates to the WTS upon death. Some of these properties have remained in the WT name, while others have been sold.
Regarding item #2 above - The evidence submitted by both parties "establishes that communications with the Judicial Committee do not fall within the scope of the privilege." A winning point for the plantiff's read: "In fact, the evidence establishes that the Judicial Committee was required to communicate information it obtained regarding potential cases of child molestation to the Watchtower Society Headquarters." This is the most damaging statement found in this motion. This alone shows that the WTS sat on this information rather than handing it to the proper authorities.

Is there such a thing as a 'consenting minor'? I guess I wasn't aware that it would ever be ok for a minor and an adult to have sexual relations. Is there such a viewpoint from a legal point of view?

Ahhh, good ol' Michigan weather. I think our electric was around $60 and gas was up to around $30(1500sqft). We open the windows at night and shut everything up during the day(the cool night temps helps keep it down). The therm gets put at 77 during the day, but I don't think it runs very much if at all. I think the forecast is showing we *might* hit 90 this weekend. During the colder winter months, we spend roughly $140 for everything.

I'm not advocating this or anything, but..... what would stop exjw's from suing the WTS over breach of confidentiality? The same breach that was described in these documents? If the clergy-penitent confidentiality was broken due to communications with hq, can they be held liable for this? In other words, can the WTS be sued out of existence for sharing jc details between congregation/hq? It sure sounds as if the appellate judge views it this way(maybe not the suing part though).
Hit 'em in the wallet and they'll go bye bye!

Whew! A lot of reading, but very worthwhile.
In a nutshell, the WTS has its "nuts" in a vise and Love & Norris are the one's turning the handle.
I bet the WTS is already coming up with new ways to get out of this predicament they've put themselves into. The way this is panning out, they will have to eliminate the communication pathway from the elders to hq. They *might* even have to do away with the 3-man JC.

Went to a witness party....oh, excuse me, "gathering" over the weekend.....
by enlightenedcynic inthe mrs. and i were invited to a "gathering" this weekend.
was just supposed to be some friends getting together for some food and fellowship.
when we arrived, there were a bunch of jw's in the back yard(50 to 100) and the music was pumping loud(not that i minded{smile}).

I remember going to this huge party out on some ranch area in a remote area of San Diego w/ a friend of mine.
Was this in either Jamul or Lakeside?? There was one family in the hall(dad was an elder) whose spread we referred to as "Party HQ." The other family lived in Lakeside but went to our congo(back then, the Alpine congo went to the Lakeside hall). The parents were not that "strong" in the truth and of course the kids followed suit. Those kids were the biggest drunks I ever knew. I honestly thought that everyone at my high school, collectively, were not as bad as these kids were. But they didn't just have alcohol - they made the pilgrimage to TJ like everyone else did. Only they brought back the stuff that the rest of us witness kids were too scared to bring back.
I agree, us Socal kids knew how to party. Stone cold wasted is a good description.
