Anyone that has any legal background whatsoever knows that it only takes the slighest change in factual circumstances to totally change a legal decision.
Your hypothetical scenario is not even on the same planet as the BERRY scenario.
Generally, the WTS is responsible for NOT placing a child in a custodial position with a known child molestor. Whether the WTS "knows or should have known" that an "official" has the propensity to molest a child is dependent on the factual circumstances. Whether the abuse occurred in a "custodial" circumstance is also dependent on the factual circumstances. What "duty", if any, is "owed" depends on the factual circumstances. Whether the "duty" was "breached" depends on the factual circumstances. Whether the "breach" was actually the "legal/proximate cause" of the molestation is dependent on the circumstances. And so forth.

i have made contact with a journalist in new england who is planning to attend the recent lawsuit filed in wilton, nh against the jw elders, the congregation, and the watchtower society in new york.
the writer will give me direct reports which i am permitted to pass along to you as the trial progresses.. we are waiting to find out exactly which courthouse it will be held and what the trial dates are before finalizing plans.
however, as each trial day ends, i will post any updates as i receive them.. should you have any question or issues that you want the journalist to respond to or pay special attention to, then feel free to comment below and i will pass these along.
As some other poster requested yesterday, those of us interested in the details of this case would be satisfied at this point if those of you "in the loop" would simply post the "Answer" from the Defendants.
It would also be nice if you could post the Calendar, as well as the inevitable Motions and Rulings.
Then, once the "groundrules" are established we will worry about the actual trial.

EDIT: I'm not going to burn a post to respond to your answer below. I don't know whether you are being a smartass, or whether you simply didn't read and/or understand the above, but all the above "things" are the "preliminaries" which set the stage for the trial, which may not take place for many months.
These "preliminaries" are just as important as the trial itself, probably more so in this case due to the "gray" legal issues.

I will not be baited into trying to legally analyse an "unrealistic" hypothetical scenario (Known child-molesting active CO), which purpose serves only to Blurr and Confuse the legal issues of ACTUAL ONGOING LAWSUITS against the WTS, such as BERRY.
If you can direct me to a newspaper story, or other documented source of such a JW scenario, I will consider such in a separate thread.
one final thing before i go on vacation:.
a while back a few of us discussed setting up a fund for ray franz, which i think is an excellent idea.
he has done so much for so many people and deserves financial help.

Moe's well-intentioned goal is being overshadowed by a poorly conceived attainment strategy. Let's not turn this thread into an analysis of RayF's financial status, which will taint COC and ISOCF as "money generators", rather than the real non-pecuniary reason(s) for their existance.
However, something else should be added to this discussion.
Purchasing COC and ISOCF from some other source other than directly from RayF at Commentary Press (Amazon, B&N, or even some XJW retailers) means that the profits go to those people, NOT RayF.
If someone wants to "crusade" here, it should be to spread the word that all purchases of ANY BOOK SOLD BY COMMENTARY PRESS (including non-authored books such as GTR, etc.) should be done directly from Commentary Press, so that all retail profits go directly to RayF.

I now seem to recall that YOU were the one that previously posted that RayF and Commentary Press were one in the same.
So why do you refer to sales of COC and ISOCF as generating mere "modest" "royalties"? There's a big difference between an author's royalties and retail profit.
I don't care whether purchasers of COC have them dropshipped to a friend, relative, library, or whatever. The point is that if someone wants to help RayF financially, then simply buy his books. I'll wager that if RayF were asked, he would prefer the purchase of one of his books to an outright "gift" of money. Think about it!

my mother told my husband that there is to be a 'special meeting' in october at the local sports arena (same place as dc's are held here) and that "only publishers are allowed to attend" that they will get "special cards" for admission from their local congregation and have to hand them in to get into the building.
i have no idea if this has anything to do with the "annual meeting" they always have (isn't that generally in october?

Persons supposedly in the know have stated on this DB that RayF and Contemporary Press are one in the same.
Thus, whenever you order either COC or ISOCF directly from him, he pockets all the profit.
Thus, to funnel $$$ to RayF, simply order COC from CP, and have him dropship itto a JW relative. I suppose he would do so anonymously, or even include a card or letter.
EDIT: As has been pointed out in later posts, RayF's corp is "Commentary Press", not "Contemporary Press". This is kinda like my occasional referring to "Utopian Reformist" as "Utilitarian Reformist". Feel free to refer to me as "MadAss" anytime.
