  now that we have appealed, the watchtower also cross appealed with 10 pages of why the "judge erred".

  looks like this has openned a whole can of worms.

  Yes,

  I had given my lawyer a very good understanding of the jw's. In fact I know he knows the way the work very well. As was mentioned here before in an earlier post, He represented another jw elder in many lawsuits against the society. So this is not new to him. From what I understand from my lawyer is we have to wait until aug 22 or so to find out what the next step will be. I have been told by a source that they intented to appeal the whole time, and I doubt they will drop the appeal even if we do. But then again.....I could be wrong. You just never know what they will do or say.

  Iam very interested in knowing about this family discussion that was mentioned. Could you pm me please.

  Iam working on another angle this week, if it all pans out I will let the board know the news. Iam awaiting al call from a very important person, so I have to leave for now. I will be back later.

  thanks elsewhere, even if I gave them to my lawyer on a silver platter he still would not know what to do with them. I don't understand how something so simiple can be so hard. I just don't know what else to do. If anyone knows any lawyers in ontario who work pro bono, tell them to call. The exjws sueing in the states have help from big law firms, Iam worried this case will be dismissed if I don't act and do something fast, but what...? I know you are there for me Diana. Thanks..and to all who listen.......I hope I can give you all some good news soon. I don't want to loose this battle for all who follow. That would really suck.....to all the Mike Mosses out there. vic

Now that we have appealed, the watchtower also cross appealed with 10 pages of why the "judge erred". Looks like this has openned a whole can of worms. We are not sure what this means. Our lawyer appealed without letting us know, and now we are not sure what to do. Our lawyer just says we will see what happens aug 28th at the court house when the judge will give her decision on costs. They are still going after me for costs, and now the cross appeal. The watchtower feels that the $5000.00 decision was "excessive". They also think that the judge erred in her finding that " the plantiff felt she had no choice but to follow the process directed by the jw elders"" "the judge erred in finding that there was a duty of care imposed on the defendant wt." ..the judge erred "in finding that the plaintiff had been forbidden to develop relationships with anyone outside the faith and had been trained to obey the elders without question and that disobeying the elders was literally inconceivable to the plaintiff at the time." These are just a few points they make. There are 20 or more points.

  Is it worth it to sue the Society?

  a few weeks back i helped my brother move out of a shared apartment to a rented room in a rooming house.

  there's no question that the years of having been a jw took their emotional, physical and mental toll on him and now as a former witness, life is not easy for him.. he understood when i refused to help him move the boxes and boxes of wt literature, the "apostate" cassettes/vhs tapes and other literature.

  i asked him why he had to keep these things that had hurt him so much and he replied that "it was for the lawsuits".. i wondered in the back of my mind how many others obsessed over suing the wt society.

  This is Vicki Boer, Iam really the one that should be answering that question, and it is a difficult one to answer. It has been a difficult battle. There were times when I wanted to give up. THe watchtower does try to wear you down so that you don't have the energy to keep fighting. Then when it comes to a settlement with a gag order, most people take it, and justice is not served again. They know the ropes very well. Its sickening the dirty games they play. BUT>>>>>>>>>>>>>>>>if someone does not fight them, the abuse of victums will never stop. So its not a matter of " should we do this?," its "yes, we have to do this"!!!!!!!!!!!!!! What choice did I have. Could I live the rest of my life knowing I could change child abuse policy and protect future children. I did not have a choice. My conscience would not allow me to give up. Even when times are hard like they are right now, I know I do not have a choice in this. Perhaps its a higher power directing me to clean out the sickness in the organization. Would you want your children to suffer the way I did? THe only support I had was my husband. We had no one else. THe rest of my family are jw's. Though recently my sister and brothers have left. If you knew you could save one life, but that it could have dire affects on your own, would you do it? Yes, to me its clear. I will just have to deal with what ever else this organization throws at me. Its just money, lives are far more important. Worst case happens, they take away all that I own financially, but they can't take my husband and kids from me. vicki boer

  Hello Impartial, I know this is fustrating for you as it is for me. I come here for moral support and you have to realize that most people here do not know anything more about the law then most. We all live in different parts of the country and even the world. So to put something together like fund raising or help with law is almost impossible. I need all of these people to be a sounding board for me at a time when we have no one else to go to. Sometimes I go on about how mad I am and fustrated I am at the courts and the judge, but I don't exspect anyone here to be able to help me other than to listen to my endless whinning. I don't understand what you want people on this forum to do? They listen, and understand. I few of them are behind the scenes and work at press releases and give more than moral support, but there is nothing more anyone can do. I have milked every possible resourse to figure this one out, but now I will have to sit back and let what will be, be. Thanks, and I do wish there was more I could do with your help. You seem to want to help so badly. Not many can say that. I have to sit back and wait the judges decision. vic

  good job hawk, I know you had a rough day with all my legal s***t. Glad to see the article got you feeling better. I know it made me feel much better. Just hope my judge will read it while on vacation. I feel for these people filing the lawsuit. We all know what goes on inside the borg, but getting all of our evidence together and presenting it is another story. Sounds like they have some kick a** lawyers who know what they are doing. I can't wait to read more about it. I wonder if these 6 were made to confront their abusers in meetings after meetings. Iam sure they were. This is so good!!!!! Iam so excited to not be the only one. I hope they realize the long battle they have in front of them. But it is all worth it. Hang in there guys in california if you are reading this. Its a battle that is long over due. vic

  Impartial.

  As a former councel you know that we cannot just give information publicly when it is before the courts. As soon as the judge made her ruling on the trial it was posted for all to see. Now that the matter of costs is before the courts we cannot just give you the information for fear that it would somehow taint the process and give the JW's a chance to appeal.

  You now make threats about our sincerity on this thread. We are sincere but cautious when it comes to dealings with the JW's. We have passed your suggestions on to our lawyer, but as we have said before, we cannot give as public information matters that are before the court.

  As stated we have not recieved the submissions from either side, If it comes to an appeal then we would love to have your opinion on strategy.

  We appreciate your offer to help but our lawyer is telling us that we have to be careful about what we say and do until it is all over.

  Thanks sf,

  I really will take your advice on fund raising. Canada 411 is currently having some problems, so our name is not on it, and perhaps that is why impartial had a hard time finding my lawyer. They told me it should be fixed soon. Mr.Bowen has my address as well. I now Simon said it was important to not put personal info here so I must respect his wishes. I know its for my safety. I will send out private email to get more info on ways to do it.
