Ghomeshi Trial

ghomeshi is charged with sexual assault by at least three women for hitting, hair pulling, and other physical abuse during romantic encounters.
his defense so far has been that this activity was consensual "rough sex" and these complaints are from jilted ex-lovers.

We've had some lengthy heated threads about high profile US court cases, so I thought I'd start one about a sensational Canadian trial going on now.
Ghomeshi is charged with sexual assault by at least three women for hitting, hair pulling, and other physical abuse during romantic encounters. His defense so far has been that this activity was consensual "rough sex" and these complaints are from jilted ex-lovers. (That's my synopsis, don't take it at face value, Google it).
The trial is interesting as it is starting a national conversation about how alleged victims are treated by the system. It may also raise questions about how we collectively fail to uphold the presumption of innocence.
So far the first accuser has testified. She was pretty beat up by the defense. Many inconsistencies were brought up. She said she had no further contact, but it turns out she sent emails up to a year later. She even sent a bikini photo and asked him to contact her. She said after the assault she could not stand to watch him or hear his voice. But in the emails she compliments on his recent work and specifically said she was watching and listening to his shows. She didn't accurately remember the car the alleged hair pulling assault was in. She spoke about how her memories have changed as she has "sat with them" that has better memories now than when she gave her earlier accounts to police and the media. There are other items, which you can read up on.
So, the Judge has to determine if this is a confused victim who is credible, despite memory lapses and poor judgement, or if Ghomeshi when/if he testifies is more credible.
How do you feel about aggressive cross examination in these sorts of cases, necessary for our justice system or a re-victimization of someone who may have fuzzy memories stemming from a traumatic event?

Has anybody watched Making A Murderer on Netflix ?
by smiddy ini watched this 10 part series the other day and i was appalled at the investigation conducted by the police , especially the way they conducted their investigation with brendan vassey , his interrogation and obvious manipulation by the police officers , i couldn`t believe he was convicted , and sentenced to a jail term.. to any intelligent person with any sense of compassion could see brendan vassey was intellectually disadvantaged , yet these police officers exploited that failing of this boy .he should never have been convicted , his case should have been thrown out of court , the fact that he has been in jail over 10 years is a gross miscarriage of justice .. the conviction of steven avery seemed to me to be a set up also from what was presented on netflix ,.
i am no fan of steven avery ,i think he is a bit of a hillbilly type , that has had no problem with cruelty to animals , which i abhor ,yet i do think he has been railroaded in this conviction ,while the real killer and rapist goes free .. what are your thoughts .

Billzfan23, I tend to mostly agree with you, after watching and then reading online. Only, I'm fairly convinced Stephen is guilty. The vehicle was found by an a warrant-less illegal search, called in, and then the quick search of the property was requested when Stephen was absent in order to ensure the evidence could be used. Brandon is really a victim, both by Stephen getting him involved and the terrible way the justice system pinned it on him.
That's my opinion, anyway. Nevertheless, the conduct of the County and the prosecution is enough for many people to claim there is reasonable doubt, and I do respect that.
For me, the circumstantial and undisputed evidence is pretty damning.

Oh well, It was unlikely I would remain in ignorance until I got around to seeing the film.

Even Now, You Haunt Me...
by Garrett ineven after leaving the organization, it still lurks in the background like a shadow.. as some of you know, i met a wonderful girl a while ago (which i'm going to need your help with).
she is a catholic and i am open and very respectful of her beliefs.
however, i know there will be a time where i will have to tell her that i once was a witness... and to be honest, i'm quite scared of that.. i don't want things to be ruined between us because of a disgusting cult that i was in.

So, I married a nice Catholic lady and I couldn't be happier. Our daughter is the most adorable toddler that has ever existed and we have a boy on the way. Her parents are strongly Catholic, in fact they are members of the Secular Franciscan Order. They are great people and our relationship is strong.
Happy to chat with you about any of the related issues - marriage, child baptism, meeting the priests, what do do when they chant prayer before dinner, etc.
If I may be so bold, I fear your biggest problem isn't her, it is your sense of shame, like you have done something wrong. You haven't. You just have a wildly interesting history with a strange religion. Own it, laugh at it, stop being scared of it.
Everyone knows I used to be a JW. I mention it often. At work I might say, "Well, if I could sell the WatchTower I can easily sell that!" Sometimes I just make a joke like, "When I was in a cult we used to...". The reactions are loads of fun.
Think of all the awkwardness that came from denying participation in everything as a JW. This is way easier.
Don't let your own shame sabotage this relationship. I recommend you work on self-acceptance and change the narrative you are playing in your head. When you tell more people and they, astonished, ask you questions about all the stuff you did and you bring up the crazy stuff you believed, you will start to reduce your shame and will realize it is just an experience. It is just what happened.

he's my age and has shunned me for the past 4 years despite my efforts to reach out to him.today, i noticed a listing online that states he is a director of his congregation.
i suppose only elders can fill this position (he wasn't an elder when i was a jw).

In my jurisdiction every corporation has to appoint directors, it is mandatory and not something for shallow appearance. We routinely pull the corporate records for all new customers to ensure directors are signing our legal paperwork. If not, we have an Officer's Certificate done up wherein a director can appoint another signing authority to bind the corporation.
Nothing to see here.

we kept in touch via skype and text messages because lived kinda far from each other.
eventually her mother heard of the stuff and said to her daughter that the chatting must stop.... well, when two people have a little crush on one another, it sure doesn't.

The bottom line.... Underage is illegal. Against the law regardless of the "cultural norms" of the JW cult.
The conversation keeps equivocating on this point. Is the issue the law, in which case you have to consider the location of the OP and whether the young lady was 16 or 15, or is the issue what is acceptable, normal, and not creepy?
I think the pertinent issue is the creepy factor. When the law is brought up, you have to be willing to accept that US law on such things as alcohol consumption, gun ownership, or the age of consent (which varies by state, anyway) is not somehow the moral yardstick for the rest of humanity. America is pretty damn important, but not THAT important.
