Well even if they win the appeal I think they are getting the message that the more control they have over their members by mean of their in house kangaroo court system compose of unqualified and uneducated elders the more legal problems will develop. Isn't it time for the WT corporation to trash this system to avoid many more lawsuits in the future? The Governing Boobies need to really try to wrap their minds around this dilemma and do something humane and constructive and get off this "We are the Faithful Slave" cloud and come down to planet Earth.

Sort of like a refinement of the bill of rights that makes lawsuits possible. You would have to sue over a right or over actual damages that can be proven. There is no right to speak with people, people are allowed to chose to speak with whoever they want from a legal point of view.
How about using the DF'n someone to chill his free speech to warn his loved ones about a cruel fraud being perpetrated on them by the WT corporation in to abject servitude. Say a person warns his friends and relatives about the fraud and he is DF'd for doing so? I think if in that order they might has a 1st amendment violation.
Intentional infliction of emotional distress is such a high bar that few people can ever reach it in the huge number of legal proceedings a year. There is no assault or other criminal act either.
That why a good expert witness could really help the case.

I'm thinking maybe the young baptized JW children have a better shot at making a case and proving emotional harm by being DF'd I'm sure that would have a better chance in court especially with some reputable psychologist, testimony and add to that all the child abuse lawsuits they had and are having could be used as evidence against them.

The District Court, Sifton, J., held that: (1) it was beyond the powers of court to stop excommunication so long as excommunication results of nothing more than plaintiff being excluded from his religious community, and (2) allegations that plaintiff will suffer battery, trespass or theft in the absence of religious prohibition against those acts did not warrant injunction in absence of showing that such injury was imminent or likely.
I think this bears repeating:

So If it can be proven that that something More than the plantiff just being excluded from being with his religious community caused him harm. And lets not forget he's asking for a court order to stop excumincation which is beyound the reaches of the court.
