Looking forward to a test case in the future. It may be true that the that was the intent of the 1st, maybe an amendment might make it possible? What do you think? Sort of like a refinement of the bill of rights that makes lawsuits possible. Maybe a refinement of the rights religious freedom, speech, and thought that removes the shelter from these abusive mind control cults.

It would never survive summary judgement. Because no civil court can enter itself within a dispute with in a religious membership issue.

Then don't make it a membership issue and focus on the ordeal of going through a phony judicial herring denied any semblance of justice.

You would have to sue over a right or over actual damages that can be proven. There is no right to speak with people, people are allowed to chose to speak with whoever they want from a legal point of view.

How about using the DF'n someone to chill his free speech to warn his loved ones about a cruel fraud being perpetrated on them by the WT corporation in to abject servitude. Say a person warns his friends and relatives about the fraud and he is DF'd for doing so? I think if in that order they might has a 1st amendment violation.

Intentional infliction of emotional distress is such a high bar that few people can ever reach it in the huge number of legal proceedings a year. There is no assault or other criminal act either.

That why a good expert witness could really help the case.

I'm thinking maybe the young baptized JW children have a better shot at making a case and proving emotional harm by being DF'd I'm sure that would have a better chance in court especially with some reputable psychologist, testimony and add to that all the child abuse lawsuits they had and are having could be used as evidence against them.

They want to be in control of every feeling a child has and let nothing come before their love for Jehoohoowuwaa and his earthly organization. This kind of stuff should hang these guys in court about being abusive to kids and their tender emotions. With their court room track recorder of huge lawsuit pay outs that they try keep hidden from their members while they teach this utter garbage to kids with threats of disfellowshipping, to make sure they really listen.

The GB are treading of some very slippery ground here. You bet the lawyers hoping to get their hooks in them before they go bankrupt to which they better hurry.

In action under RICO and state law, plaintiff moved for writ of mandate prohibiting rabbinical congress and defendants from making any efforts to have plaintiff withdraw action and submit it to rabbinical court and from excommunicating plaintiff, his counsel and staff. The District Court, Sifton, J., held that: (1) it was beyond the powers of court to stop excommunication so long as excommunication results of nothing more than plaintiff being excluded from his religious community, and (2) allegations that plaintiff will suffer battery, trespass or theft in the absence of religious prohibition against those acts did not warrant injunction in absence of showing that such injury was imminent or likely.

I think this bears repeating:

So If it can be proven that that something More than the plantiff just being excluded from being with his religious community caused him harm. And lets not forget he's asking for a court order to stop excumincation which is beyound the reaches of the court.

I would I got really god dam worldly and did all the things I would like to do but didn't because I was a JW. I had a lot of repression and I found relatively semi safe way of un repressing. I wanted to find the authentic me what ever it was and get back in touch with myself. This is a never ending search for the real self. Boy was I glad to shake all that utter bull shit indoctrinated in me.
