  It should be an interesting case. Fire departments, even if they are municipal or government, are subject to the same hiring laws as the rest of us. The courts will determine, among other things, whether marching in parades and flag ceremonies are essential tasks or responsibilities of being a fire-fighter.

  Even if the job description includes these things, and it is doubtful they do, the courts will determine whether they are essential functions, whether employees knew about them before being hired, whether they are included in written, posted job descriptions and whether they have implemented the processes consistently.

  It will be difficult for the entity to make a case that these are essential functions, but not impossible. A few weeks ago we discussed this on the gay rights' OP. Some believed that an X-tian minister who was employed by a government entity for the sole purpose of conducting civil marriage ceremonies could use religion as a reason not to marry gays. Since marrying people is an essential function of the job (I mean, come on, it's the only function of the job), they likely have no legal recourse. And shouldn't. As for the Dub fire-fighter???

  From "The Adventures of Tom Sawyer" by Mark Twain:

  He took up his brush and went tranquilly to work. Ben Rogers hove in sight presently – the very boy, of all boys, whose ridicule he had been dreading.

  “Hello, old chap, you got to work, hey?”

  Tom wheeled suddenly and said: “Why, it’s you, Ben! I warn’t noticing.”

  That put the thing in a new light. Ben stopped nibbling his apple. Tom swept his brush daintily back and forth – stepped back to note the effect – added a touch here and there – criticised the effect again – Ben watching every move and getting more and more interested, more and more absorbed. Presently he said:

  “Say, Tom, let me whitewash a little.”

  Tom considered, was about to consent; but he altered his mind:

  “No – no – I reckon it wouldn’t hardly do, Ben. You see, Aunt Polly’s awful particular about this fence – right here on the street, you know – but if it was the back fence I wouldn’t mind and she wouldn’t. Yes, she’s awful particular about this fence; it’s got to be done very careful; I reckon there ain’t one boy in a thousand, maybe two thousand, that can do it the way it’s got to be done.”

  “Oh, shucks, I’ll be just as careful. Now lemme try. Say – I’ll give you the core of my apple.”

  “Well, here – No, Ben, now don’t. I’m afeard – ”

  “I’ll give you all of it!”

  Tom gave up the brush with reluctance in his face, but alacrity in his heart. And while the late steamer Big Missouri worked and sweated in the sun, the retired artist sat on a barrel in the shade close by, dangled his legs, munched his apple, and planned the slaughter of more innocents.

  There was no lack of material; boys happened along every little while; they came to jeer, but remained to whitewash. By the time Ben was fagged out, Tom had traded the next chance to Billy Fisher for a kite, in good repair; and when he played out, Johnny Miller bought in for a dead rat and a string to swing it with – and so on, and so on, hour after hour. And when the middle of the afternoon came, from being a poor poverty-stricken boy in the morning, Tom was literally rolling in wealth.

  He had besides the things before mentioned, twelve marbles, part of a jews-harp, a piece of blue bottle-glass to look through, a spool cannon, a key that wouldn’t unlock anything, a fragment of chalk, a glass stopper of a decanter, a tin soldier, a couple of tadpoles, six fire-crackers, a kitten with only one eye, a brass door-knob, a dog-collar – but no dog – the handle of a knife, four pieces of orange-peel, and a dilapidated old window sash.

  He had had a nice, good, idle time all the while – plenty of company – and the fence had three coats of whitewash on it!

  If he hadn’t run out of whitewash he would have bankrupted every boy in the village.

  bodies of elders around the world will soon (tm) receive a nicely worded letter from the christian congregation of jehovah's witnesses, telling them that local elders are now responsible for ensuring that no perverts are allowed to be alone with any children on any kind of witness business, otherwise, the boe will be accountable to the courts - not the org!.

  The lawyers on both sides are likely now controlling responses. The Dark Lords will act like the End of Time cult leaders they are: reactionary, paranoid and myopic. Whatever they do will almost certainly be guided by WT legal. In the same manner, there are likely many similar cases in the queue that have waited anxiously for the Conti case to run through the review process so that they can craft their own effective strategies.

  The cases coming next will seek to address any weaknesses in the Conti case. And so it goes.

  Agree. I'm trying to be kind to Ninja and give him the benefit of the doubt if possible. After he made this comment about me “the witty diarrhea constantly spilling out of his (DJS) mouth", my next response to him was:

  This is a powerful, well written, statement. If Ninja would take his passion, his intelligence and energy and use it in a more effective manner he could accomplish a lot in making the Dark Lords squirm.

  Keep reading Ninja, there are a lot of these laws. And an injunction is always a possibility, as I mentioned, which doesn't require a law. But please, by all means continue to do what you are doing and post the videos on You Tube and other places. They will be used against you sooner or later.

  You should be thanking me for doing your research for you; at least now you know enough to check the various state laws before your next stunt. Your haste to respond didn't include checking formatting. Please, Ninja, your followers are watching. Get a grip.

  But it is good to know, Ninja, that I am living, rent-free, 3 centimeters from your unattached prefrontal cortex. Touched a raw nerve there, did I Mr. You Tube star? How was the wine? As I remember, they always bought cheap ass red.

  I told myself I was going to stay out of this OP. I don’t mean to be mean, but the lack of intelligence illustrated by some in responding to this OP continues to amaze me. The premise that these individuals were operating within their legal rights is a 5 minute google search. Google “is it legal to disrupt church services in the US” and you will see that you are wrong. A lot of states have laws against this, and even if there isn’t a local law, if they do these types of stunts more than once at a KH, the Dark Lords can get an injunction to stop them from entering any KH. You know, injunction, that legal thing-ey.

  
  

  And the narcissistic look at how cute we are videos posted on You Tube and other places? They will be used as evidence against them by attorneys and considered by the courts to very quickly slap an injunction on these individuals. Stupid hobbitses. So continue to take video selfies and post them; the process will ultimately regulate itself.

  From what we saw none of us are saying that these individuals meant violence, but that is not the issue. They are in someone else’s space, a sanctuary, committing an aggressive, disruptive act. Do you really think that if they continue these types of actions that sooner or later someone is not going to get hurt? Really? I commend those elders who passively observed the obnoxiousness. When I saw one reach out to touch the star of the show (Ninja) on the back and get his attention I was wondering if all hell would break loose. What the fukk do you think is going on with these people? What do you think was occurring with the blood pressure, heart rate, respiration and adrenaline of these elders??? Although calm, without a doubt some of these men were preparing to kick his sorry ass if he made the first wrong move. Google “church shootings” or “church disruptions” or “church security” and you will be very surprised what you see. Yes, pbrow, there are armed deacons. Lots.

  sickening to see the photo of the religious zealots all stood around the governor signing into law the right for people to discriminate against others (gay, lesbian, trans-gender) based purely on religious dogma.. if religious people want those freedoms then the can't have it both ways - they cannot complain if *they* are discriminated against.. "sorry, we don't like zionists, get out".

  Funny stuff. Didn't you hear Obama's comments the other day about all of the really nasty comments he gets from X-tians? I don't recall him saying anything about hate mail from atheists. And Viv, excuse me, but grow a BACKBONE? WTF? Are you losing your edginess that we have all come to know, expect and love? Backbone? That is not the body parts he needs to grow according to the Viv I know and love.
