Judicial Question: To All Active Elders..Or Those Requested to Meet...

    Dear Friends,

    I have a question, that I was hoping someone out there would be able to answer:

    What would happen if the Judicial Committee recieved a letter from a medical doctor stating that due to a medical condition so & so will not be attending the JC meeting and the situation would be reviewed in 30 days by the doctor.

    What was or would most likely be the response or outcome? Would the JC committee ignore this Medical Letter? Would they be most likely to push ahead with the meeting anyway?? Or would they be obligated to go along with this situation?? Is there any guidlines for them to follow under this type of situation, or is it up to the desgretion of each Elder body??

    If anyone has been in this situation, what happened to you?? Any current Elders, or those who were Elders opinions please????

    Well, I think it would have to be a bit more descriptive letter possibly talking about how that persons stress level simply can't be raised becasue they are on the brink of having a heart attack (or something like that).

    I actually know a JW couple whose husband actually did have a heart attack from all of the stress he had coming out of the borg. His wife told the elders when they where 'stopping by' that they almost killed her husband and that she didn't want them around. They never bothered them again.

    In that situation the local body had done some pretty bad things and knew of their guilt. I guess they where affraid of the possible legal implications and just left it at that.

    I think a wise body of elder would honor it but since there is nothing specifically written down in their elders book about this situation

    they really can do according to their " feelings and wisdom ".

    It would only work if the doctor had the letter authorized by 2 or 3 witnesses. A notarized letter with a witness present might hold off the dogs. As my friend Roland would say, "what's the difference between a hitman and a J.C.? A hitman once in a while has some compassion."

    minimus is absolutely correct. I think the direction given would likely be 1) is the letter legit?, 2) what did the person do (allegedly)?, 3) is the person a "danger" to the congregation, 4) did they confess or were they turned in?

    My guess would be that they just wait the 30 days and try again. I've seen it take almost that long to get one together due to scheduling conflicts anyway.

    After the 30 days, if another letter came, it would likely be ignored. Unless, as Drew's case mentioned, the elders didn't want Bethel involved because it would expose them for something they wanted to hide.

    There are no written guidelines (unless it came out within the last 8 months). The procedure would be to 1) call the CO or 2) call the Service desk directly.

    I've been in many congs. and known (and am related to) many elders. I think the answer is: it depends on the body of elders. Some are reasonable others are asses.

    They would probably call the Legal Dept. for advise.

    In my experience, they could care less. I actually had a friend who was a respected elder call the JC and tell them my doctor did not recommend adding any further stress since I was recovering from two back-to-back hospital stays. They backed down for a week, but it really did not matter to them what I was going through even though I was no threat to anyone and had not been to a meeting (aside from the Memorial) in over a year. I think it matters if they are still human and have some compassion left in their shriveled souls.
