Should the US Comander and Chief be Under the Same Law as the Citizens?

There are plenty of scholars who would say that ignoring habeas corpus is a pretty blatant violation of Constitutional Law.

That's why I have some glimmer of hope if Obama get to be Prez.

I think you all need to recognize that pissing you off does not constitute breaking any laws.

Look in the mirror what was Clinton's impeachment other than Republicans pissed they couldn't find anything better to impeach him.

Our government in the USA is a Republic. That means that the power is of the People. If the President is a person then the law applies to him as much as to anyone else. In a perfect world that is. Reality is that these assbags get and do whatever they want.

The last time this issue was raised was regarding Nixon's role in Watergate. Nixon felt the President was above the law in that he felt the President did not have to obey a directive from the Supreme Court. He also saw nothing wrong with directing the FBI and CIA to spy on American citizens.

That crisis was resolved, albeit painfully, with the understanding that the President (i.e., Executive Branch) is NOT above the law.

Now, 30+ years later we're going over the same ground, on almost exactly the same points. Cheney refuses to release any data regarding who visits the Vice President's office, much less what is discussed.

The President authorizes torture and withdraws habeas corpus, one of the most fundamental rights in the Constitution.

Unfortnatey the difference now is Congress is so weakened by corruption, special interests and apathy it is the Do Nothing Congress, so the Executive has not been called on the carpet about their wrongdoings.

I wonder, as information starts oozing out in the next 10 or 15 years, will anyone care or be shocked or will anything be done to correct the mistakes?

    Chris

If Congress would grow a pair, this wouldn't be an issue. Over the last fifty or sixty years (going back at least to Korea when Truman deployed troops with no authorization to do so) congress has been letting the President walk all over it. John Kerry and Hilary Clinton both voted to authorize the use of force in Iraq. Do you think they should be accountable as well? We need a legislative branch that thinks about something other than getting re-elected.

True. That's why term limits should be imposed on the members of Congress (just like the President) so that they know up front that their "service" is exactly that ... public service ... NOT a career. Perhaps 12 years should be a max (2 Senate terms and 6 House terms).
