If you need to keep your job to make it, do whatever it takes to get his approval and stay on his good side. With a down economy, many companies are making employees cuts. The easiest way to make it look legal is to lay the groundwork then say the employee has "performance issues".
Just because a person is the boss doesn't mean they know how to boss effectively.

Carry a tape recorder in your pocket. That's what I did. When management was presented with the tapes, at a union grievance, they went ballistic. The bosses boss suggested that my supervisor sue me. Then they tried to intimidate me by promising to give me a ream of legal documents supposedly showing that what I did was illegal. Finally they gave me what I had wanted and the supervisor had promised me but later denied.
