    Question, can an Ex spouse collect on your social security? Yes

    The requirements are:

    You had been married for at least 10 years..

    You have been divorced for at least 2 years

    You are UNMARRIED(him)

    You are not eligible for an equal or higher benefit based on his or her own work or someone elses work.

    No, He is not eligible if he has remarried..

    ps..regarding your last question about you collecting half..no you will collect your full benefit, you would only get half if you collect off his social security. Hopefully he really is remarried!!

    I just talked to someone at SS. He can collect 50% if he files at normal retirement age (65) If he files for early retirement, which he did he can get 35%...but only if I am collecting already...which I am not. Apparently, if he does try to collect, it won't effect the amount I am entitled to... WHEW!!!

    Did you tell them he has remarried?

    According to the guidelines I posted they can't collect ever if they have remarried.

    Thanks Snoozy! He really is remarried. Even better! I forgot to ask the remarried question... but you answered it for me!! Thank you sooo much! He has applied for a green card for his new wife... looks like he will have her working to support them....

    My jw xhusband recently started collecting SS. He is 62. I was married to him for almost 20 years, and we filed taxes jointly. We divorced in 1990. I don't think he paid much into SS if at all..
    coffee_black: Surely he paid in self-employment tax. This is the self-employed equivalent to social security tax. The difference is, those who are self-employed pay in the full 15.3%. Wage earners, on the other hand, pay half and their employer pays the other half. If he filed income taxes during those years and showed a profit, he's bound to have paid his self-employment taxes, and therefore is entitled to SS.

    Hubby died when I was only 61. I was able to collect a reduced benefit off my work history when I turned 62. I collected that until I turned 65 and then switched over to hubbys. I was able to collect his full benefits when I turned 65.
    Thanks to calling the SS department and the patience of one of their service reps that explained things that others wouldn't volunteer..

    He was pretty sketchy about business accounting. He always claimed a loss. Never a profit... ever. In truth he never made much. My income is what usually supported us...

    Just a thought..doesn't Phillipino's get Social Security also?

    Maybe he is collecting off hers, if she is collecting.
