Elders and liability issues

  If the motive of such a lawsuit is money, clearly the target is the publishing company.

  If the motive was to expose the Organization for what it really is, go after the elders alone and see whether or not the Organization would distance themselves. If they did distance themselves, can you imagine the wakeup call this would give?

  If an elder was sued for wrongful death and the Society was not named as a defendant, can you imagine the potential distress this would cause the elder(s)? Would the elder(s) be told by the Society, "after reviewing the documents, the Society is not listed as a defendant, if we provide you with assistance, this could give the perception to the court that the Organization accepts responsibility for the actions of independent agents, we have to allow you to be on your own on this one"?

  With the advent of the new elders book, is this issue covered in that they are being told to get coverage??

  It would seem that someone who is suing the society would also include their home congregation and the elders... would the congregation then be involved? Or could, if the lawsuit was won by the plaintiff, the hall be lost because of the win? If there is a win, could the elders lose their homes,etc?

  Band on the Run

  I'm a lawyer. All parties should be named. Some might be seen as juicier than others. Frankly, I don't know how anyone with even a car in assets serves without insurance. The Society most certainly is a repeat player lawsuit. Their legal costs may be lower b/c the issues have already been litigated and the research is complete or only needs to be edited slightly. How we know that the Society does not insult? We would have no access to that info if it were protected by a confidentiality agreement.

  Family members sue other family members. Protection makes sense. The Society is not leaving it up to Jehovah, their personal God. It seems silly to leave your hard-won assets to the caprice of a lawyer.
