Would it be charged as a hate crime?

I doubt it. There would have to be some other circumstance probably. Like were the ppl involved known for having racist views or something like that.

IMO, the chick must've been in some kinda shock brought on by the trauma of the accident and the drugs. It's still no excuse though. This is just something that's just horrible, horrible.

I don't know, Bigboi. There were others involved. She called her friends so they were involved. Her boyfriend was involved. That shows a group mentality. I'm sure this could be spun that way. Like I said, I'm glad this has not been clasified as a hate crime.

I couldn't believe it when I heard it either,I couldn't imagine someone driving down the road whith a peroson hanging out the windshield let alone pulling in the garage and letting him bleed to death.I almost posted that myself.I am going to try and keep track of all the most absurd stories this year and so far that one takes the cake.I know people in texas drive like maniacs but god you figure you could at least call an ambulance and show a little compassion.

    Tim,

As horrible as this story is, it does not even come close to satisfying the prequesites for being considered a hate crime. The Hate Crimes Act gives the Federal government more authority to investigate and prosecute criminals who committed their crime because of the perceived sexual orientation, gender, or disability of the victim.

As far as we know, the man was not targeted as a victim because of his race.

When I first heard this, it sounded like one of those anecdotal stories tht turn out to be untrue. I am horrifed to see that police have confirmed the events.

Dont tell the witnesses , they will say its just a sign of the times

You're missing the point. Hitting the man was not a hate crime. It was an accident. Leaving him to die a slow death on the windshield in her garage could easily be called a hate crime. Can it be proven? Yes! Anytime you kill someone, it's a hate crime. If the man had been black would she or one of her friends have called for help? I think it might have made a difference.

    Congress defines hate crime as:

" a crime in which the defendant intentionally selects a victim, or in the case of a property crime, the property that is the object of the crime, because of the actual or perceived race, color, national origin, ethnicity, gender, disability, or sexual orientation of any person."

    Section 280003(a) of the
    Violent Crime Control and
    Law Enforcement Act of
    1994 (28 U.S.C. 994 note).

    Hope that helps. Tyydyy

So does your definition of a hate crime match the federal government's definition? Do you just accept that someone deserves to die twice because it was a "hate" crime? Every time you kill someone intentionally it's a hate crime. Every time.
