Can a Skillful Lawyer use this information in court as evidence of lack of fullfillment of Fuduciary Duty on thier part since they claim to be the only true religion and obedience is a life and death matter.

Just saying could not the Governing Body just be falling into a trap of thier own making and not even be consciously realizing it? And maybe consciously and unconsciously thier legal team is pushing them that way conspiracy theorys could take many turns on that one.

How about conspiracies that operate in the collective unconscious level, conspirering against them unconscious to them making themselve thier own worst enemy.

They might be pious and crazy enough to believe that by opening themselves up to legal attacks, if the secular authorities go after them it will be like touching Jehovah's eye. Maybe even viewing it as God's direction to entice Gog thinking he has an opening when all along it was a trap.

    In a word - No.

The courts do not care about the obscure Watchtower definitions of their weird doctrines.

The Governing Body's decision to declare themselves the Faithful And Discreet Slave is a bold manuever.

Steven Unthank in Australia successfully charged the Faithful And Discreet Slave for non compliance with the Working With Children Act.

Watchtower claimed that the Faithful and Discreet slave was a ecclesiastical designation which isolated individuals from legal liability.

The Governing Body is now identifying the FDS with an identifiable group of people. This is an egregious move considering that the FDS was charged in Australia.

The October 1, 2012 Letter to all Bodies of Elders regarding Child Abuse stipulates that the Society takes responsibility for decisions about child abuse. In terms of legal liability, this might be good for the elders but not the Watchtower Society. The Governing Body of Jehovah's Witnesses has placed themselves wide open for legal liability.

Nope, as the letter still obliges elders to elevate concerns to WTS in order to make the final call on repeat offenders, to be labelled as "predators".

Hence, the local elders STILL face full responsibility if they fail to elevate such concerns to WTS, and the WTS can (and likely will) use a defense of elders keeping them "out of the loop" by trying to resolve the matter completely at the local level. That gives them an effective shield.

KS... ^^^ agreed. Really nothing has changed has it?

Not really, Tylin, other than the Society has laid out a process that must be followed by all.

The elders can SHARE the blame with WTBTS, but ALL still have skin in the game but only IF the elders elevate the matter to the Society. If anything, a lack of notification by elders effectively SHIELDS the Society from liability, rather than exposes them.

    KS,

I think a good lawyer would set his sights on the head part of the organization because more money is there as oppossed to elders which they may use to leverage thier cooperation in going after the real money boys.

Anyway the more entrenched stand of the Governing Body in thier delusion of spokespersons for the Almighty and their behaivor of authoritarians is a two edged sword both granting them authority and making them responcible legally. of course I say this as my opinion and with literally no experience in the legal system.

Fuduciary Duty seems to be at stake here:

A good lawyer would certainly go after the heads of the organization - but my point is that their own wacky definition of the "faithful and discrete slave" does not really mean anything legally.

The fact that they have appointed themselves the governing body of Jehovah's Witnesses does.

The courts are not interested in WBT$ Doctrine..

They are interested in the WBT$ complying with the law..

The WBT$ has made themselves more responsible..

I know Rick Simons has more cases coming up..

There is no way he wouldn`t use the new information against the WBT$..

    Again..

It has nothing to do with WBT$ Doctrine..It has to do with the WBT$ breaking the law..
