jamiebowers - yep, that's a significant stated reason for the motion. If you read Simons' official response, he says (rather amusingly IMO)...
The Church Defendants argue they should be permitted such a substitution to protect Plaintiff from financial exposure to the costs of their surety bond when she loses this appeal.
Although the concern of the Church Defendants for Ms. Conti is heartwarming, if somewhat belated, their request is specifically prohibited by statute.
