According to the docket, WTS was notified that their opening brief has not been timely filed. Their appeal will be dismissed if there is no further activity by February 22, 2013.

I'm sure they will have something by the 22nd.
I don't know anything about law or legal tactics, but perhaps they knew this, and decided to invest some extra time in their brief. I can't imagine them giving up $20 million or however the amount is now.

It's about much more than money. The second the appeal process is final all EXJW's will have serious ammunition to anti-witness with. People who previously settled out of court with the Watchtower could be described in the witness mind as profiteers with immoral intentions. Rick Simons and the Conti family's strategy has put the Watchtower in a catch 22 situation. If they appeal in court they'll have to defend the indefensible which will be documented and go straight on WatchtowerDocuments.com. Basically they are having to choose between being hung or shot. Figuratively of course. This will be a victory for a lot of people who have worked tirelessly for many decades.

The WTBTS is trying to stretch the case out for as long as possible. Luckily Candace Conti is young and thankfully the case is being appealed in California, so hopefully in a year or two the WTBTS will no longer be able to advertise that they are not protecting pedophiles.

O would suspect that the longer they make the process, they feel that both Conti and Simons will tire. The need for some cash now may arise. Of course, Simons is looking at quite a windfall if he wins.
I imagine that they have hired consultants on special topics. Other religions may have been consulted so they can supply supporting briefs.
