Stealth: If they were to find out about this recording, they would not need to prosecute anyone in order to disfellowship her again.
You are absolutely correct. I was only addressing the legality of the recording and the possible legal repercussions as raised by Chaserious on page 1 of this thread:
Chaserious: ... it might not be a bad idea to seek some advice on whether recording elders' deliberations could be problematic from a legal standpoint, especially if you plan to publish more of these should they become available. - [Underlining added]
That being said, the elders would have to realize they'd been fooled to bring her up on further judicial charges. Many would rather let it go than deal with that cognitive dissonce. Some would be so furious that they'd have a hard-on for vengeance until she was out.
Either way, it's proof that either there is no "Holy Spirit" involved with these proceedings or that "Holy Spirit" was ok with this particular apostate fooling those three elders. It's kind of a "Lose/Lose" situation for the elders on the particular judicial committee.
If they wanted to make a legal issue of the fact that she recorded the meeting without their knowledge or permission then the entire transcript and recording would become a matter of public record. Besides the obvious embarrassment of their foolishness, the do NOT want these proceedings to become public.
