The civil trial in Japan

    Hello everyone,

    Finally in Japan, there happened a civil trial which is by a brother who was unfairly deleted his status by a body of elders of his congregation. He has sued them for religious and power harassment. Although the brother's name and details are not told, the trial is progressing to the middle stage. In Japan it is very rare that a believer wakes up elders for treatment in a congregation. Because it has been said Japanese are too gentle. Probably the first case in Japanese JW history. I will post more details later.

    Hi japanesegirl. I saw this post on jwr the other day so I tried 'googling' for some info.

    Can you share some of the info you already have on this matter, such as location or amount he is suing for, or if the suit is against the individual bros that got him deleted or if he is suing The WTS or all. Thanks!

    I am a lawyer. It would be interesting to know the legal basis of the civil action. My understanding is that Japan has many of the same civil righs as the U.S. Constitution. The First Amendment right to free religion would be a bar to most actions against the Witnesses. I understand that Japan is incredibly nonlitigious society in contrast to the United States. You have hardly any lawyers. This is very interesting.

    GOTR, I do not understand why the non - involvement of the STATE(s) in religion preclude a CIVIL suit asking for redress of a tort?

    Why have not elders & E-bodies been sued for the unspeakable harm they have done? is it a money question?

    JG: perhaps your nation's natural dignity takes affront to personal affronts, losing face? and that is the breach that we all need?

    It depends on the factual circumstances. Most of the time people here see lawsuits there is no cause of action possible. Courts will not police religious matters. If an elder hit someone's car, it is a tort. Somehow I don't think that it is the sort of case mentioned here. Some details would be nice to know.
