    ecan6:
The person who filmed was not involved in the sexual activity. Hence, I know for a fact that he cannot show this video to anyone as legal recourse can be done against him.
Did either or both of the other parties know that they were being taped?
"I know for a fact..." - please elaborate on this fact. Does this fact originate with a lawyer?

I don't know about the legal issues involved in that country, but according to WT policy, the only 2 things capable of forming a JC are confession and 2 human witnesses, nothing else. So, videotape is *not* typically capable of forming a JC, unless it leads the alleged "sinner" to confess. If the accused does not confess even in front of a videotape, a JC cannot be formed.

OrphanCow, the "I know for a fact" is based on the fact that I police report could be filed for this.

Both party did not agree to be taped.

    No minors were involved.

Police reports can be filed for lots of things. It doesn't necessarily mean that a law has been broken - police are not attorneys - they do not interpret the law. That job is for the courts to decide.
