Now that a New Hampshire judge has opened the way for the elders to be sued in the Berry molestation case, it's relieving to know that you can't be sued because you're an "untrained volunteer" elder. I wonder if these guys smugly think that since the Watchtower Society is defending them, God will make sure they will not get into any trouble.

Oh, the brothers do see it... and they know what is going on.
In the Flock book they are given explicit instructions to not put any reference to the WTS on any documents regarding the DFing of people. You don't have to be a genius to figure out that this is to insulate the WTS from lawsuits.
The brothers are more than willing to "fall on their swords" for the WTS. Remember, they believe that the WTS is Jehover's organization, and if they think they can save
Jehoverthe WTS from a lawsuit, then they will do what ever is necessary. -

While it is possible that an idividual elder can be sued. Lawyers usually position their suits based upon the abilty to collect money. Thus, an elder with no education and works as a window washer does not have much to worry about.
Also, perhaps someone can and some additional insight into this. I remember during the time that I was an elder that someone told me that the society maintains some sort of liabilty insurance on each of the elders to protect them incase of law suits. I have no other information other than what was told to me.

Wouldn't you still be liable for actions you took as an elder even though no longer serving? It would make for an interesting situation to see if the Society would do anything to assist.

If the Society was to defend an ex-elder and that ex was no longer totally supportive of WT. policies, things would get very interesting! I think that the Society might just give token legal representation. If elders were really going to be taken care of by the Society, every elder would know it. It is PRESUMED that the Society would defend them. I question that.

Benext, you paint an interesting scenario. What if an individual was sued because of his actions as an elder however by the time suit was filed the individual was no longer a witnesses. Because the society might have a vested interest in the outcome they may be forced to help out. If that ever happens to me, I’ll let you know
