NEED HELP! WTS accusing Dirtclod.com of copyright infringement

    Even if something is copyrighted (which all works are, just the degree of protection and enforecment varies) ir is still possible and within your rights to copy and quote information when doing any sort of critical review:

    Copyright Notice: The Watchtower Bible and Tract Society holds the copyright for many quotes used on this site, therefore this information is posted under the provisions of international Copyright law, which allows for excerpts to be published, for the purpose of review and/or study, without first obtaining the express written consent of the copyright holder. According to the FAQ a the U.S. Copyright office:

    How much of someone else's work can I use without getting permission?Under the fair use doctrine of the U.S. copyright statute, it is permissible to use limited portions of a work including quotes, for purposes such as commentary, criticism, news reporting, and scholarly reports. There are no legal rules permitting the use of specific number of words counts, a certain number of musical notes, or percentages of a work. Whether a particular use qualifies as fair use depends on all the circumstances. See Circular 21 and FL 102.

    The above mentioned FAQ is a simple language synopsis of relevant copyright law, in particular ยง107 of the US Code -- Title 17 - Copyrights; Chapter 1-- Subject Matter and Scope of Copyrights.

    There is no set 'amount' that you are allowed to copy but given the vast amount of stuff the WTS has published, even quite parge amounts are a small percentage.

    It would be harder to defend this is whole works were published without commentary though.

    One thing I would say Jourles, fight them when you know you can win but don't put yourself on the line.

    I'm sure that even if the material had to be taken down, another site would most likely spring up elsewhere. Such is the wonder of the web - once a genie is out of the bottle it can never be put back in

    I was reading through the thread. You mentioned the complaint was sent by email?

    I can pretty much guarantee it was NOT sent by the Society but adds credence to the possiblity I raised earlier that a "righteous over much" JW took it upon themselves to complain to the ISP.

    Before doing anything else I would verify the source of the complaint. That action by itself may solve your problems for now. If this is true you should send them a letter of thanks for giving you advance warning and a chance to protect yourself better should the real WTBS ever make a complaint.

    You're right, Mr. Kim, because the WTS is re-active, while the free worldwide community, working in concert and solo, are pro-active.

    Even a nuclear re-active strike from them cannot unscramble their eggs.

    Mr Kim, are you referring to lawsuits against the WT that are looming in the near future? Or is there something else coming as well?

    Jourles, can you PM with the URL for the zipped BOE letters? I would like to.. ahem... examine them closely so that I might give my non-lawyer opinion of any possible copyright infringement. Yeah, that's it.
