@Closer: The decisions in these cases are completely arbitrary, there are no hard and fast rules for these situations. Most likely, if they are deemed 'repentant' they will be 'reproved/restricted' for a while and then nothing else comes of it.

It is entirely possible that the male person will not be considered for any sort of position for a lot longer, which is again arbitrarily decided, it could simply be that they will wait until the first partner gets remarried or until it gets forgotten about.

Best case scenario, if it's deemed a really egregious case and "everyone knows about it" or they are "unrepentant", they will get publicly reproved or even disfellowshipped for a while, there is little difference practically between both designations, technically you are allowed as a JW to talk to reproved people but it's strongly discouraged.

The thing is that there is no defense, no attorneys, no laws to research. The process is entirely up to the three people that signed the letter.

Well duh! "Tree elders" are sent by the "Branch" - obviously.

    @Closer

There is a difference between legally married (in jw land) and scripturally married.

You can get a legal divorce but if you remarry (legally) without "scriptural" grounds for a divorce then you have entered into an "adulterous marriage" and if they can get their ducks in a row (proof - admission by you or two witnesses or it is known you are living with your new marriage mate) they will hold a JC and DF you.

    "Scriptural" grounds means that either...

    A) Your ex had definitely done "jiggy-jiggy" with someone - or an animal! (porneia is the word they use which means penetrative or oral sex or mutual masturbation) and you have chosen not to "forgive". ("Forgiving" means you have resumed jiggy-jiggy with him or her)

    B) You have done the dirty and your ex chose to "not forgive you" and scripturally and legally divorce you first.

Oh and with modern technology- phone sex, sexting, robot sex (!) etc. this will have them spending hours or days consulting with the branch to decide what or if you have "grounds" or not! Probably not.

But no Pharisees at work here. No Sir!

It wouldn't be for dating/marrying an 'unbeliever' - that would be a 'marking' matter, NOT a JC, providing the courtship was a 'clean' one.

Therefore the most likely reason would be for entering an 'adulterous marriage'.

Shepherd the Flock of God, page 130

    Adulterous Marriage

If a divorced person remarries and he was not Scripturally free to do so - in other words, if adultery and rejection by the innocent mate had not occurred - he has entered into an adulterous marriage. In Jehovah’s eyes, he has married someone while still bound to another. Entering into such a marriage would call for judicial action.

If the disfellowshipped one was eventually reinstated, the elders would be very cautious in extending any special privileges. He could share in the cleaning and repair of the local Kingdom Hall. He may eventually give student talks in the Theocratic Ministry School if his doing so would not disturb others. However, he would not be assigned to help with literature, accounts, magazines, attendants, or similar privileges in the congregation as long as the innocent former mate is alive, unmarried, and has not been guilty of porneia. - w83 3/15 p.29.

If I recall correctly he went to live with this woman without marrying her.

And of course, only a high control cult would have a specific set of guidelines and directives printed in a book just for elders, that seems to override the bible....

StarTrekAngel: due to the brother having a marital relationship that was not aligned with bible principles.

StarTrekAngel: If I recall correctly he went to live with this woman without marrying her.

Ah right, solves that question: a marital relationship - ie he was 'living-in-sin', without the marriage.

    a marital relationship

    That's adultery.

If he's not attending meetings, most likely he will be DFd.

No, it's not.... I believe in the OP's situation it seems that they are both single people and therefore it would be fornication.

Adultery is consensual sexual intercourse between a married person and a person who is not their spouse.

Fornication is consensual sexual intercourse between two people not married to each other. When one of the partners to consensual sexual intercourse is a married person, it may be described as adultery.
