Isn't the problem that people take *no* personal responsibility? Whatever happens ... it's always someone elses fault.
I hate the litigation society and unfortunately that cancer is spreading over here too. This money doesn't come from nowhere - it gets paid in premiums from everyone, you and me.
Of course, if they had said "soffy, you are too big" then they would have been sued for descrimination.
My biggest bug-bear is on planes - you get 20Kg allowance (or whatever) but someone getting on could way double what you do ... and still get the same 20Kg. It would be better if everyone got a total allowance and if you weighed less ... well, you could take more ! (without paying extra).

There has always been an inherent element of risk to rollercoasters from the very first. (Developed in Russia, I believe.) The park and designers try to make them as safe as possible, but there is always the possibility of an accident.
An accident could have happened to him boarding an airplane or driving down the freeway. Rollercoasters are safer than freeways. Should we sue the government for an accident on the freeway because the government let us take the on ramp when they knew statistically it was risky? That's why we have insurance.
Jeesh! This is just like the Dan White Twinkie Defense I mentioned last week. "I couldn't help myself. I killed them both because I ate Twinkies and drank Coke before committing murder. I entering City Hall through a window, so my loaded gun wouldn't have to pass through the metal detectors, but it was because my mental state was affected by my sugary diet." Nobody takes responsibility for their actions or for the risks inherent in life.
It's disgusting.

Wow! This thread hits close to home for me.
I live in the same city as this man. No, he is not tall. Average height, but he is a big guy. I don't know him personally, but see him out once in a while.... (Just saw him yesterday at the store.)
Six Flags should of banned him from riding the coaster. If they had, he wouldn't of been injured. Too bad he wanted to ride, he wouldn't have a case, they have the right to refuse. I don't know if he could sue for discrimination.( If they have the right to refuse, how could he sue?) Even if he could, I would think the payout would be alot less. No medical expenses. Just emotional suffering. Seeing that they didn't use thier right to do this, who does the liability fall on? I agree some people today do not take responsibility for thier actions. But, he was injured, and the laws in the USA allow him to sue for these reasons. Right or wrong, it's his right to sue. Do I agree? Doesn't matter. That's the law. And, there are people that will take advantage of it. Quirky laws we have, aren't they? Just my personal opinion....
