He noted that in the Watchtower case, Stratton's argument fell apart because the city was unable to present the Court with compelling evidence of a correlation between door-to-door solicitation and crime.
Hensley said the Court ruled the ordinance was "overbroad" since its other stated purpose of preventing fraud did not apply to those who are not asking for money, such as petitioners or political campaigners.
Kennesaw, he said, can provide this missing link between canvassing and crime.
"Our position is anybody who is out there knocking on doors, whether they say they're a salesman, religious group or political party, if they're up to no good, they say whatever they need to say," said Hensley.
