    Well I did it Barb!

    I finally read your information.

Thank you very much for the update.

The case is pretty simple in my mind and should survive. The key will be in the depositions and what proof you can get out of the other side so that you can tip that scale in your favour to 50.1 percent (prove to a balance of probabilities). Got to love tort law.

Never put much faith in the questions posed by Judges either as an indicator on how they will rule. Oral arguments that you heard are important. But in appeals such as this, I think what your Counsel wrote down in his brief(s) for the learned Judges and the jurisprudence cited by your counsel for the Judges are most important to the case.

Of course I have all the confidence in the world that another motion will be filled by these idiots in New York. Have patience.

I believe I found the web site where the Court of Appeal will publish its decision in your case.

    The link is ... http://www.tsc.state.tn.us/OPINIONS/TCA/Oplsttca.htm

I will bookmark this site and wait patiently, much like I am doing with the Berry case in NH.

    Take care Barb and Joe!

    One other thingy ...

The case is called and numbered as follows:

Barbara J. Anderson et vir v. Watchtower Bible and Tract Society of New York, Inc., et. al.
    M2004-01066-COA-R9-CV.

You may find Barb's oral argument date in the below file:

    http://www.tsc.state.tn.us/geninfo/appellclerk/docs/archive/coamiddleoralargument4%2D05.pdf

p.s. - "et vir" when it comes to the Court .... - Husband.

    No problem.

Here is the link for the NH supreme court if you are waiting for the Berry decision - which by the way is over due and past the Court's guideline average for rendering decisions!

Gee, I just got through reading Joker 10's comments and I think there was another poster whose name has escaped me.

    .... sigh ....

Quite frankly I was thrilled that Bill came to support the Andersons and I have no problems with what he did. Between the two of them they have inoculated millions and millions of people against this group's leadership - a leadership who would rather support the pedophile than protect their own children. They have also helped thousands stand up and find their voice. And they did something else ... they got lawyers interested to help get some restitution for the survivors and to force the policies to change.

One only needs to read this little gem of a thread .. http://www.jehovahs-witness.com/11/86969/1.ashx ... to get a sense of how disgusting the Elders and the Watch Tower counsel can still be to protect their JW perverts from the police so that they keep their congregations clean. Hiding the file from the cops in this case by sending it to Bethel in Ontario was about as low as you can go.

As far as I am concerned Mr. Bowen should be attending everyone of these Court hearings.

Right Hawkaw--and, in reading the opinions posted by the Court of Appeals, I notice a trend, one that should be of concern here--it appears that in virtually every (civil) case that goes to the TN Court of Appeals, the costs of the appeal (for both sides) usually have to be paid by the party that is the clear loser on the appeal. Look at the final sentence or two of some opinions there (2nd quarter 2005, which is where we are now) and you find this to be so. Evidently, this awarding of costs is automatic at the TN appellate level, with no special petition needed for it to happen. (If there is no clear-cut winner/loser, costs might be split evenly.)

So, does this mean Barbara and Joe will have to pay all appellate costs of both sides if they lose this appeal? (memories of Vicky Boer, anyone???) What do you think?

If so, the WTS lawyers are very cheap. Haven't you heard? They volunteer their time.

    1) Bill Bowen asserts that "the Watchtower Society protects child molestors by its policies".

    (2) Bill Bowen presumably asserts "the Jehovah's Witnesses are a destructive cult".

Does (1) have anything to do with (2)? Maybe and maybe not. The point needs to be discussed and established by documented proof

Some things are more than obvious. I won't addresss them here because it is not the origional topic.

I've never seen any of Joker10's posts except the one above, but I have to say I took this one in a totally different way than the other posters in this thread.

I took it to mean that it's obvious what #1 and #2 have to do with each other: cults are known to protect wrongdoers.
