I don't believe the majority of JWs would ever do such a thing if ordered, but I know of a few who would. I remember one MS who said several times the society should send out "hit teams to whack apostates".
Whacko's are found everywhere. Every religion, every sect, every country has them.

why did they take no legal action against him?.

Does it depend on how many soldiers are invading? Or if they reach your town? I ask in order to understand how you would not engage in war yet you say you are not a pacifist. On what grounds are you not a pacifist?
