“We are not done yet!” – Candace Conti reacts to appeal court decision

candace conti (pictured in her interview with abc) has spoken out for the first time about the appeal court decision.

as current and former jehovahs witnesses digest the news that watchtowers appeal against the candace conti verdict has faltered, albeit with the punitive element of the judgment reversed, candace has reacted for the first time by telling me: we are not done yet.. news spread on monday that the state appeals court in san francisco had upheld the $2.8 million compensatory damages in the original june 2012 verdict, but overturned the $8.6 million punitive award against watchtower.. the court decided that, though watchtower had neglected its responsibility to supervise known pedophile jonathan kendrick in field ministry, a church-sponsored activity, the organization had no duty to warn parents in the congregation that a pedophile was in their midst or report him to authorities.. an insightful report by investigative reporter trey bundy has suggested that the court reached its decision because the precedent set by the conti verdict might be too burdensome to enforce.. the burden would be considerable because the precedent could require a church to intervene whenever it has reason to believe that a congregation member is capable of doing harm, and the scope of that duty could not be limited with any precision, the judges wrote.. candaces attorney rick simons responded by pointedly telling bundy: they think in public policy terms that theres too much risk in broadening the churchs responsibility and liability so that it burdens what churches do.

Anyone see "Woman in Gold" yet? Base on real story and legal case (admittedly was a confusing for me as it involved Austria also). Interesting movie. Lost in lower court but later at her lawyer's persistence went on to win at U.S. Federal Supreme Court. Took 10 years. Different issue and process than Conti case, of course. What struck me how a judge (in the movie, not sure if the statement is in court record) made a comment that Maria Altmann case would "open a can worms" involving many nations with similar atrocities.

Made me think of this last court case of Ms. Conti. Hopefully, the California Supreme Court will take the case. Maybe it's just time now for religion to be tested and judged not because of the 'government' entity but because of the conscience of the "people."

a statement that phizzy made on jonathan drake's thread on flyers gave me the following ideas.. we should make a flyer on the issue of the watchtower pedophilia issue written with the object of alerting the public about the jw door to door activity.

phizzy suggested the title, "the paedophile at your door".. on that flyer should be the contact information of our most informed member on the subject who's willing to talk to the media.

Interesting,,sounds like a further appeal (to the CA Supreme Court) may be possible?

Justice Peter Siggins wrote for the court, "While it is readily foreseeable that someone who has molested a child may do so again, the burden the duty to warn would create and the adverse social consequences the duty would produce outweigh its imposition." (unclear) "adverse social consequences" for who? The perp? Now if the elders want to call on such a person regularly, as an individual, have a personal Bible Study, that should be enough. But to require a small congregation of innocents, sitting regularly elbow to elbow, at relatively small meetings with such, having to be somewhat sociable, -- asinine. Giving a convicted perp a right to live in the neighborhood, is not the same as inviting them to your home or small church, who are unknowledgable of this persons character.

In my neighborhood, if a previously convicted perp moves into this neighborhood, his record and photo are posted all around, especially around schools and door to door. There is no secret about it.

Ms. Conti set out from the start to have the exposure of the WT policy about the 2-witness rule regarding pedophiles, she accomplished that. All court records verify now. The WT was hung by their own "Flock Book" (at the time) and elders' remarks in the court. She right from the start made clear her intention and Mr. Simon accepted that. I will not accept that the WT won this case, no matter what they say.

Originally, the Jury granted her $21M in 'punitive' damages. Later, she accepted the Judge, dropping it to $8M.

I wonder what "punitive damages is {to be} reversed with directions to 'enter judgment'" yet means. Does reversal absolutely mean $0?

It will be interesting to see if this goes further - to the CA Supreme Court now.

charity tribunal rejects jehovahs witnesses charities' latest appeal attempt.

governance | kirsty weakley | 9 apr 2015 a jehovahs witnesses charity has been refused permission to appeal a charity tribunal ruling that had denied it extra time to appeal against the opening of a statutory inquiry.

the watchtower bible and tract society and appealed the charity tribunals decision not to extend the period of time that they had to file an appeal into a statutory inquiry that had been opened by the charity commission.
