As far as I know an elder (or anyone else for that matter) would only be able to access a patient's file if that patient gives written consent.
So without written consent the elder would have no right to that file.
If the elder were to have Lasting Power of Attorney over healthcare decisions then I suspect that they will also have access to the medical file to allow them to make the "best interests" decision for the patient.
Otherwise, the argument would go that they are in posession of all the facts to enable them to make a "best interests" decision.
But we all know what type of "best interests" test would be applied by an elder in the case of a JW patient don't we?

Under the new Lasting Power of Attorney (Mental Capacity Act 2005 s9) the donor (aged over 18 years) can appoint an attorney to make Personal Welfare decisions (ie HEALTHCARE DECISIONS) on their behalf if they lose capacity to make the decision for themselves.
THE LAW WILL MAKE PROVISION FOR THE ATTORNEY TO BE GIVEN THE POWER TO REFUSE LIFE-SUSTAINING TREATMENT ON BEHALF OF THE DONOR.
The law does include some safe-guards, ie the attorney must act in the donor’s best interests.
Anyone who doubts that the attorney is acting in the donors best interests can apply to the Court of Protection.
You know where I am going with this don’t you?

Does anyone know if the WTBTS are going to encourage JWs to set up Lasting Power of Attorney so that a fellow JW (named elder or named Hospital Liaison Committee member for instance) can make the decision to refuse blood transfusions for that JW patient?
I will eat my hat (if I wore one!) if they don’t try the guilt ploy with JWs and force them to set up Lasting Power of Attorney.
Advance decisions will still be valid under this new Act, so I am sure the WTBTS will still be pushing their NO Blood cards.

on an earlier thread about ice cream i remembered a snack that was sold at assemblies and that started me thinking about some of my memories of childhood at conventions/assemblies.
i guess it was the taste/smell association because even today when i go to various convention halls for home improvement expos, car shows and the like it takes me right back to the past.
i have many memories wrapped around the conventions and experienced different things because i have lots of elders in the family that were used, literally, for food service, the accounting office, security and dramas.
I remember sitting at conventions with my family in various locations (Twickenham, Norwich and Cardiff) in the cold rain, with black bin liners wrapped around our legs, holding umbrellas and thinking.... (now this is really sad!).......... that this is great because now I cannot take notes and look up the scriptures.
Bit of a pain when you had to stand for song and prayer though!
I hated conventions - one time I did tell my book study elder my thoughts on why I hate assemblies, but he really didn't believe me. Just responded that he loved them! I never did have much time for his screwy views on life and priorities!
Our family would also end up doing cleaning and car park duty. We were first in last out.
The one good thing were the bacon sandwiches in the morning. But then they have to go and take away THE ONLY GOOD thing about the assemblies and tell everyone that food is not provided!

From reading the posts from around the world, I am amazed at the number of occurences where they have health or allergy problems!
Perhaps JWs have a higher rate of hypochondria than the rest of the population?

if you are an elder who frequents this site, please let me know.. i am trying to connect (completely anonymously - your privacy is assured) with as many elders as i can.
i know that there are hundreds of elders in the same position as myself (have had our awakening and have come to realize that "the truth" is a sham).. i encourage you to continue to serve as an elder and for you to work together with other like minded elders as a collective force for true good.
there is much we can do from the inside to help the cause.. there are thousands and indeed millions of kind and honest hearted people whose only crime is that they have allowed themselves to be deceived and are still active jws.
I am not who you need - am a woman so therefore never worthy of such a privilege!

i came here expecting to find a range of jw's and check out their beliefs and thinking.
however, what i find is largely disaffected or ex jw's and atheists etc.
with hindsight i am not that surprised either!

As an ex JW (JW for 20 yrs) I can tell you that JWs are not allowed to openly think, discuss and debate doctrine and opinion.
Yes they have book studies and bible studies, but the only literature and content JWs are allowed to discuss is that produced by the Watchtower society.
To have personal opinions is seen to be "weak in faith" and a JW would be condemned for that.
To live a true JW life is to live in a closed, insular world. To have no friends outside of the religion. To undertake no secular work that will have a negative impact on meeting attendance. To undertake no further education. To marry within the religion.
Anyone who leaves the religion is shunned and cast out from JW family and friends.
It is no wonder that these forums thrive because it is the only way that many JWS air their thoughts and opinions and discuss them with ex JWS.

what have you achieved/become since leaving the organisation that proves there is a happy, successful life outside being a jehovah's witness?
for me, although it's only been a very short time, too short to achieve much, i count becoming: non-judgemental of my fellow man; a mum that can give her kids all the room to grow and blossom without fear of 'sinning' or being kicked out for bad behaviour; a person that can feel comfortable worshipping in a church or not, depending on whatever i feel like doing; someone who can love and give freely and celebrate life in all it's glory (i just love birthdays!
I love having the ability to make my own decisions without fear of reprisal or repercussions from the elders and others in the congregation.
Particularly around healthcare decisions - the ability to weigh up the pros and cons of proposed treatment without having the added (and completely unnecessary) complication of "no blood" policy and the guilt that goes along with it.
I also enjoy using my free time in a way that benefits my family, and not feeling obligated to attend meetings and to out on the ministry, pre study etc etc etc etc etc!
I like being able to make career choices without having to consider whether I can fulfill a vocational role without it conflicting with meeting attendance.
I like being able to socialise properly with genuine friends.
I love being free!
