The biggest issue is, how has the precedent been set? In prior cases, the Borg produced similar documents but they were heavily redacted. Why did they get away with that? Since that's the precedent, they would have to have a different legal argument in order to get these documents. This is unlikely since I believe the cases are very similar. The 4K a day they have to pay, imo, will probably be vacated when the WT lawyers get in there. From what I read, they were terminated from court proceedings by the judge, and that was overturned.
Also, from what I understand, punative damages were vacated in prior, similar court cases. So, I'd guess the WT would just be paying the 3mil.
I'd be interested in understanding more about the legal argument being made here. I have access to Westlaw and Lexis, which has the legal info on it. I'll look up what's going on tomorrow.
