  NEED HELP! WTS accusing Dirtclod.com of copyright infringement

  i just got this email this evening from the cto of my hosting provider: i am writing you in regards to your site www.dirtclod.com.

  we have been forwarded a copy of a complaint that was sent to our upstream provider regarding your site and the content which is posted on your site.

  it would seem that you are posting copyrighted sections and images which are legal property of watchtower bible and tract society of new york inc. please remove these offending letters and images which are being claimed are used without permission, or provide us a statement which allows you to publish/reproduce this content on your website.

  Not more scaremongering?!

  Refer to page one of that thread and the comments from the ISP:

  "We have been forwarded a copy of a complaint that was sent to our upstream provider regarding your site and the content which is posted on your site..."

  The site was HOSTING copyright material.You cannot host copyright material.

  This forum is not hosting anything, and the webmaster is not uploading and sharing illegal files!

  So, no need to panic at all. Calm down people.

  On another thread, posted 8 hours before this post, Simon writes:

  So, there really is no reason for anyone to be ashamed or nervous. I joined and started posting because a certain member was providing bad legal advice and, frankly, scaring Lady Lee and others for no good legal reason. DMCA is not something to be afraid of - if a copyrighted work has been uploaded the copyright owner or some one who is a person “authorized to act on behalf of the owner of an exclusive right that is allegedly infringed” can send a DMCA notification. The file then has to be removed. To clarify that further, DMCA applies if the file is hosted within the jurisdiction of a United States court - DMCA is an American law, not a global one. In other countries, different laws apply. If that happens in a reasonable time, the law is satisfied.

  As I have written before, DMCA does not force forum webmasters to remove links if someone posts a link to a third party site. It refers to the uploading and hosting of the file itself. This is logical if you think about it - Google would be guilty if their search results brought up any links to copyrighted works - it is just not workable, and the law recognises that.

  Anyone authorised can send a DMCA notice, not just a lawyer. In fact, what goes inside such a notice is described within the act itself. However, it sounds more impressive if it is signed by a lawyer, especially if the recipient is unfamiliar with DMCA law.

  No case has ever been brought and won against any forum because some of its users have posted a few links to third party sites. Yet for some reason there are still some here afraid that the WT Legal team can file a case against this site for DMCA violations. Simon's words quoted above put it all into a more proper perspective and hopefully people reading this will regain their calm and Lady Lee can once again sleep at night.

  i'm sure the legal, public relations and other depts.

  are all asking the gb how to handle this situation.

  and i'm convinced the gb is scratching it's head trying to decipher j's spirit direction in all of this.

  The DMCA is a law in the United States. It is not an organisation and no one can complain to it.

  What they did was send out a DMCA takedown notification. This requires sites hosting the material to remove the file. Although in law it is only valid if the servers hosting the files are situated inside the United States, most sites will respect the DMCA notice.

  Although they complained to Simon about the links, since the files were not hosted on his site the DMCA notification did not strictly apply, but it is always wise to avoid conflict and Simon decided to remove the links to err on the side of caution. This is his site, and he can set the rules.

  The book is copyrighted. That means the WT has the legal right to demand that it is not made available online.

  Sorry Lady Lee, but I must respectfully disagree with you.

  djeggnog was not providing valid legal reasoning. He was quoting from a case that did not even reach a judgment - it was settled between both parties. Even worse, rather than quoting from a Judge's summation, he was quoting directly from the prosecution lawyer. This is not precedent and a good lawyer would never do it.

  So I posted some details to rufute it. It was djeggnog who immediately attacked, saying I should reserve my 'glory' seeking comments and 'nonsense' for 'immature ones'. That was offensive and when I PM'd you about it you did not agree, which is your right.

  djeggnog was the subject of other negative posts by other members - the majority objecting to his verbose replies, self-justification and generally condescending and arrogant tone.

  djeggnog should be welcome here to post his opinions, JW or not. However, that same courtesy should be shown by him to other posters who write something he does not agree with. That did not happen, and that is why things got out of hand.

  PS Being a mod is hard work and you do a great job for the site, dealing with so many different people as you do. As for people posting links after you and Simon have asked them not to, that is wrong and I have always said in all my posts that links should not be posted out of respect for the site owner's request.

  i stepped down in feb 2010. there has been much talk and the was stated many links removed do to wts.

  I am, and it is not in the least bit illegal to post a link to that image. But that is not the issue - Simon has asked that the links are not posted and that was a way around it that still did not meet the spirit of the request.

  Unfortunately the DMCA original thread was also removed, so there is a lot of censorship that goes on here, but the mods have the right to decide what gets left and what does not.

  i had the misery recently of attending the sad.. the bethel speaker looked and sounded like the usual corporate businessman after your money.. during his main talk, he praised a recent bethel member who left his college (aka university) course early to pioneer and join bethel.. that followed experiences from window cleaners, unemployed, parents home-schooling (aka child abuse - it is a basic human right to be educated) their kids and those baptised as children (youngest was 10).. the brainwashed dubs applauded every ruined life paraded on the platform.. these bethel speakers have been around long enough to know exactly what they're doing - they are evil men, ruining peoples' lives, breaking up families and masquerading as holy men.. their time will come when they face god - too late for the many ruined by their filthy lies and false hopes.. sorry to sound bitter, but to my shame i had a part in this cult as an elder.

  what part of my brain did i lose to not see through this rubbish?.

  better late then never though.

  What is ironic is that Bethel employs, well, not actually employs or they would have to give someone who has been in faithful sevice for years some actual benefits, and they don't want to do THAT, anyway, has as members of the Bethel family lawyers (maybe even reading this) doctors nurses and so on. If everyone did as they recommended none of them would have ever finished college, but I guess for those that ignored the advice, and later end up in bethel it is OK.

  yes, that's right, they really do not like people being able to read that book so they wanted links to it removed (it appears they have also been going after the hosts of the content itself as well).. unfortunately, i had to removed the links (which were dead anyway when i checked) and i'd ask that people don't re-post them (sorry).

  i'm sure there are lots of alternative ways for those with the information to get it to those who need it.. here are the discussions on the book:.

  @djeggnog, you often use carefully worded sentences to get around posting guidline #1 Insulting, threatening or provoking language.

  You often hyjack the thread with long ramblings of self-justification, contrary to #10 Posting an off-topic comment.

  Frankly, it is no surprise to me to hear you are still a Jehovah's Witness - your attitude reminds me of quite a few elders and their wives I have known over the years. (This sentence is in your style - I do not actually say that your attitude is bad, though some may reach that conclusion :) )

  I am glad that being here helps you, (hopefully not just to count hours in FS) but, unless you want to alienate everyone here, you are going to have to learn to be less impressed with your own opinions and more respectful of others.

  Back to the topic at hand, (because I do not want to break the rules mentioned above either) the WT has the law on their side if this book is posted online. It is copyrighted.

  This evil organization is feeling the effects of the Internet and for that I am very glad - forums like this are able to help those who have been hurt by the GB and their bogus interpretation of scripture.

  We do need to keep the fight legal because although the WT says the world is in the power of Satan, they in fact use its laws and agencies to full effect to protect their own interests. It is only they, apparently, in their minds, who can engage in illegal activity (such as in lands that their activities are restricted or in countries like France where they are expected to pay taxes) and say they are obeying god rather than men - the rest of us have to obey the law to the letter. Hypocrisy - hell yes!
