this is to commend vicki boer for having pressed her lawsuit successfully against the watchtower itself, thus setting a precedent for future lawsuits.
it is regretted that the judge did not reward her more than a mere $5,000 which won't even start to pay for the hassle, but future judges can now use the precedent and some may award other victims of watchtower pedophilia in the millions of dollars.

Canada is ahead of the USA when it comes to balancing the rights of people vs religion. Hopefully Judges in the USA will read my case and follow suit. Its very important for judges to realize the damage that can be done when a ped is allowed to wander freely within an organization. They should have no rights of religious freedom. Religion was not built to be a shelter for these people. The bible clearly says that children are our most valued posession, god would never have allowed these people to continue to hurt his children. Jesus himself would have never sheltered them. Ped's need help, and we are not helping them by allowing them to continue to molest.

witnesses to abuse
I think we need to work on the process of the jw's. According to their own books all cases must be reported to bethel. As jw's, if they go to the elders about a problem it is not in secret. THey do not believe in confessions. We all understood it is a process. From publisher to elder to bethel. WE ALL KNOW THAT. The publisher is seeking assisstance from the elder not absolution,like in the catholic church. THere is a very big difference. We need to make the judge very clear on this point. There are no secrets amoungst elders that don't get told to bethel. This is a fact. THats were the data base of 25,000 abusers comes from. THe catholics don't have this because everything that is said in confessionals stays with them. We need to prove to the judge that the jw's have a policy and a process that is not ment to be secret.

as most are aware, vicki boer has been long awaiting a decision to be handed down in a case she started against the society in canada.. the decision was handed down today.
as with any 55 page decision, it will take some time for the legal experts to hash it over and decipher what was said.
but, in a nutshell..... vicki won.

Charles mark has been doing alot of family law, divorce, land settlements, etc. This was his first big case in years. He was having a hard time remembering points, and did not do the proper prepping of witnesses. He is very intelligent and funny, but did not put together all the evidence we gave him to make a great case. Scott and I spent 5 years doing our own research, finding witnesses, putting together questions for him to ask, and he used little to none of it. In fact I personnally took notes for him during the trial. After he questioned a witness, he would ask me if there was anything I wanted to add, but would rarely use what evidence I had found. It was all very fustrating. He kept saying we had to make the case more simple, and that there was "no way they could out of it". Well they almost did. If he had put together the info we had found, it would have went better. For example, we gave him the flock book to use, and he didn't. He had forgotten to include some really important letters into evidence, and it was too late to add it. So this is what hawk is talking about. He did what he thought was his best. But many thought otherwise.

I have spent the last few days crying about the decision. After reading Hawks point I will hold my head high, and be proud of what i have accomplished. Hawk clearly defined the decision for me, and pointed out things I never realized. THank you hawk. You really are a lifesaver. Iam feeling much more content today. I justed needed to hear that from you. He is right in thanking all of you for your kind words of support. Most of whom i haven't even thank personally.

in case nobody else has heard it, the swedish jw who was the "main personage" in the television program aired a month or so ago, was df'ed yesterday.
the branch hung up upon him in the program and asked him to write a letter, giving his story how he had been abused etc.
the branch overseer told the reporters how sorry he felt for him, and that he had been helped, and how they wanted to help him in the future, too.
Perhaps this lawsuit of mine will be of some good. The judge basically says she found them guilty of not following their "own policy". If the wt society has a policy in place to df someone, and doesn't follow it, which could therefore lead to neglegence. Just a thought. This is new law that will hopefully come through unless the wt appeals my case.
