It must be really nice to think that you are never the problem with any of your life issues. That all good things that have happened to you are because of how wonderful you are and everything bad that happens to you is because of Watchtower.

The other members vote in a member for a defined term. It also requires in the bylaws that the member be a member of the special fulltime order of Jehovah's Witnesses.

Yes, the representative plaintiff was abused by a family member, and regardless of their religious belief, the abuse would have happened. The mother at any time could have asked her adult son to leave, as he was well over 18 when the mother was informed of the abuse.
Also, the Canadian Supreme Court ruled that a civil court cannot rule if a person can or cannot be a part of a religion. The plaintiff is asking for the court to interpret if religion provided enough support to someone who was abused. What standard are they going to use, what words does someone have to say in order for them not be held liable in a lawsuit? A large part of the lawsuit is that the plaintiff says that because the person wasn't removed from the religion then the mental abuse continued. Again their Supreme Court ruled that is not a thing that a court can decide.

Watchtower volunteer injuries
by neat blue dog ini was recently talking with a zealous 'sister' who for years was assigned to use a certain chemical while taking care of wt property, only to have it irreparably damage her immune system partly because she wasn't trained properly.
she said there was a potential lawsuit but she didn't want to bring reproach on jehovah's organization.
has anybody else heard of similar situations, of people being hurt or injured in service to the org, maybe even because of them, and taking the loss so the org wouldn't look bad?.

I have actually heard the opposite. That Watchtower actually asked for an official lawsuit because that is what is required for their insurance to pay out.

The complication of trying to make a constitutional amendment would be impossible. There are a number of cases where people try to sue watchtower an individual congregation or individual elders. Also other religions and their congregations. You cant sue over a JC or a DFing

The court cannot look at the proceedings or an internal religious discipline. You would have to ask the court to look into a religious practice and for them to say this is acceptable and this is not. That would be a violation of the establishment and expression clause of the 1st ammendment.
A private organization can stop free speech all they want, just like a private citizen can stop free speech. The constitutional protections is for protecting citizens against goverment action. Not private action.
Intentional infliction of emotional distress has to meet I believe 4 criteria. 1 is that it must shock the senses of the general community. Expelling a person from a private organization doesnt shock the senses.

It would never survive summary judgement. Because no civil court can enter itself within a dispute with in a religious membership issue.

You would have to sue over a right or over actual damages that can be proven. There is no right to speak with people, people are allowed to chose to speak with whoever they want from a legal point of view. Intentional infliction of emotional distress is such a high bar that few people can ever reach it in the huge number of legal proceedings a year. There is no assault or other criminal act either.

watchtower’s main argument is that stuff was said in confidence with confidentiality surrounding that confidence and they are confident that clergy confidentiality which is in confidence is confidential.. in short, it ‘was a secret and should stay a secret.’.
omg.. and watchtower claims that this verdict “violates the constitution of the usa”.. i wish the jury could tack on another $50m and include watchtower lawyers are to be hanged.. i just had to say something.

This is the actual wording of the statute. MCA 41-3-201 (6) (c)
(c) A member of the clergy or a priest is not required to make a report under this section if the communication is required to be confidential by canon law, church doctrine, or established church practice
The statute removes the intent of the person who is giving the communication and does not allow them to lift the privilege. The person who owns the privilege is the clergy member.
