Noni,
Did you make an effort to communicate with the seller regarding your issues? You never stated that the Seller refused to take it back.
Communication is often the overlooked key to resolving disputes.

The only things I have ever bought on Ebay were several pattern books for Plastic canvas needlework. Hubby has the account and has been buying woodworking tools for a while now. We have never had any problem with any of our purchases.
I DID see a case on "Judge Judy" recently where a woman had bought what she THOUGHT was jewelry (I have forgotten exactly what it was--I'll say it was a ring) and received A PICTURE of what she thought she was buying. She took the owner to court for fraud and the defendant claimed there was NO FRAUD because the advertisement stated that " this a picture of a ring...a size 7, x amount of carats, etc" and that the plaintiff at fault---she should have READ IT more carefully. From what I recall, she was charged (and paid) $300 for a piece of paper with a picture of a ring on it.
The defendant lost the case.
you can open up a "case" on paypal ... check it out!
Take it to a pawn shop.
I used to manage some for a company in Texas.
Most of them do an acid test on every piece they see to make sure it is not plated.
makes no sense when people say ..."don't use ebay/paypal"
it's not the medium but the "seller". check out the sellers ratings before you buy!!!!!!!!!!
noni: what are his/her ratings? do you mind posting on here the sellers name???

I'm a huge Judge Judy fan and you have it wrong, it had nothing to do with jewelry, it DID have to do with 2 cell phones, the two scammers claimed the woman had paid for a picture of the phones not for the actual phones, best judge Judy ever.
With all due respect to "What-a-Coincidence," please don't post the seller's name publicly. Those wishing to know the identity of the seller can be informed via pm.
Folks, if Simon is going to keep this forum going for all of us, we have to make an effort to not create problems. Posting the names of individuals or entities you're having a dispute with draws JWD into the dispute. This is a "discussion forum," not a dispute resolution forum. Let's keep it that way, or we might find ourselves with no forum at all.
Noni, I have extensive experience with E-Bay, both as a seller and as a buyer. The first step is to advise the Seller of your concerns, and see if he/she will take the item back. If that is not successful, you can always post negative feedback about the seller, but be aware that neither negative nor positive feedback can ever be removed by users. If you paid via Paypal, Paypal offers some options for dispute resolution as well. On a personal note, I'd use the negative feedback option as a last resort, as it's irreversible. PM me if you need additional information. Good luck!

TRUE TRUE
Hey thanks for the concern.I did contact the seller. My pay-pal account shows a refund but it hasn't been added to my visa yet.I can't find my dispute on either ebay or pay-pal so I think it was closed with the refund which I haven't gotten yet.I'll wait till it either shows as a credit to my paypal account or my visa before I send the ring back. The seller didn't ask me too but I'm going to anyway.I'm going to send it registired mail which the seller will have to sign for to get with delivery notifacation. That way I know the seller got the ring back.
I'm not sure how refunds work on pay-pal because I've never had a situation like this.I'm a new ebay user in that I've bought a few items in 2005 and I haven't been on there since.I don't know if it will be put back on my credit card or be a credit on pay-pal.Either way I can't find the disputes I made this morning at all.
I was extremly upset and felt taken advantage of.If the ring had been at least 10 k gold I would have not had a problem at all.I don't want plated gold for $46.00 plus $14.99 shipping when I can go to Kmart up the street and get a ring like that for $9.99.$60.99 is a lot of money for plated gold and fake stones.
I don't think I'll be dealing with ebay anymore after this.
"My pay-pal account shows a refund but it hasn't been added to my visa yet"
you have to manually transfer it over
