Yes, if YOU disassociate yourself there is no JC meeting BUT if you want to return, you still have to get by a tribunal.
The elder who wanted to DF a dead guy did not get his way. I heard that the BOE thought he was a stupid exbethelite. He was the same guy that confessed to a whole room of elders at an elder's school that he "had a problem with masturbation" I was there.....dopey guy.

Based on my effort (making the same threat of legal action), you're right. My circumstances were somewhat different, and, in all honesty, my threat was hollow even as I said it...I was just sort of hoping that it would work. It didn't.
I think what turned the tables in the case I mentioned was that the JW threatened to sue that elder personally.

I know if I had been an elder and I thought I'd be sued, I'd want to stop being an elder----which is what I did. I was always nervous that I'd have someone try to go after me, personally.

MINIMUS- Good question, good thread. I agree you can't stop them from having a committee against you , or stop them from trying to DF you in absentia if you stand them up and don't attend, ( as I found out early this year ) . However, that being said, you can give them holy hell if you feel you have been unjustly charged, as I was , and appeal it with all guns firing at them, ( as I did ). I did some of the things Onacruse mentioned , threatened to sue their a$$e$ if they DFed me without proof or unjustly , and submitted a letter my " pretend " attorney wrote .
When I refused to meet with their initial committee after harassing me for 8 months , they sent 2 elders 90 miles to tell me they had DFed me even though I never met with them. I was not going to let them have control and power over whether I could still talk to my witness mother 80 and dad 82. So, that's why I fought it. Took my 22 year old son to the appeal JC meeting as my witness ! He stood up to the bastards, told them he thought it was ridiculous what they were doing to me , stood up for my character . The appeal committee couldn't come to a decision immediately, so they wrote the society, they waited another month and told me the direction they got from " mama society " was not to DF on lack of evidence . So they sucked 10 months out of my wife and my life and time to reach that decision. If they dug down really deep, I'm sure they could find better things to do- like go hunting for more pedophiles ! Jeez. But my take is, if you have a good case against them, no proof- and want to still talk to witness relatives, grab the damned control stick back out of the elders hands. They only have as much power over your life as you give them. I chose to give them , none ! Peace out, Mr. Flipper

I know personally of one case where the JW in question was approached by an elder (who I also have known for many years) and said that there would need to be a JC. The JW came straight out and said "I haven't been associated for years, and I don't recognize your authority to come after me after all this time. But if you do, I warn you that my attorney will institute charges against you personally, against the congregation, and against the Society, and we will pursue the litigation vigorously."
I haven't been disfellowshipped yet. I think the key is to say that you will sue individual elders and then list your grievances.
However the tension and doubt about what action they can take against you and about whether or not they have formed a judicial committee against you (in my case for warning people about a molester) will always be there.
I think at the end of the day if they can destroy your reputation then they may feel they don't need to publicly disfellowship. But I do find that the whole disfellowshipping thing bothers me less and less nowadays, because I'm feeling more successful in getting my life together.
