What is the best way to deal with the IRS?

    Is this because their parent(s) filed first and claimed the kids as dependents before you did??

    I dont think it matters who files first, in your case it appears there are two or more claiming the children.

    Without proper documentation the IRS assumes the parent is the official custodian.

    Bring as much documentation as possible to prove you are a court appointed guardian. Still, the IRS are a$$holes and that might not help at all.

    First thing, I recommend checking all the lines. There could be some mistake you made, like the above-mentioned having someone else claiming the child as their dependent. In that case, you legitimately owe the $4800 (that is, unless you are willing to go through a big fight to claim your right to not pay income tax at all. Technically, you don't have to pay, but it is a huge hassle and they will wrangle the law to get you into trouble anyway).

    If the return is clean, you are in for a kangaroo court. They have been known to arbitrarily assign larger amounts of debt. You pay the original $4800, and they claim there is another $200,000 or more in penalty or in additional debt. Usually, at that point, it is because they want to ruin people's lives and not because you actually owe that much. The "tax courts" are rigged so it is usually unwinnable for the victim.

    Get a tax attorney, preferrably one that used to work for them. There are actually a good deal of them where I live, I am sure you would be able to find ne no problem.

I have said it before and I will say it again please inform yourself before you repeat the things you have just heard. Please read Neal Boortz's book on the natiional retail sales tax.     Here is a quote from the IRS Pub 17:

    http://www.irs.gov/pub/irs-pdf/p17.pdf

    If you and the other person(s) cannot agree
    on who will claim the child and more than one
    person files a return claiming the same child, the
    IRS will disallow all but one of the claims using
    the tie-breaker rule in Table 3-2.

    Tie breaker Rule:

    IF more than one person files a return claiming
    the same qualifying child and only one of the persons is the child’s parent,

    THEN the child will be treated as the qualifying child of the parent.

    The key is to have a written document agreeing that you will file using the children as your dependent. Without a written document the IRS will revert to the Tie-Breaker rule.

    Update:

    I will follow up later - due to time issues. But I just got a call from the IRS informing me that they have agreed to leave my taxes as filed.

    Wooooopeeeeeee! I am so happy right now. Usually these things end up biting me square in the ass. I knew I was right on this - but was beginning to doubt that I could win.

    BTW I have a relative that works for them.

    The reason the are such A-holes is because 90% of the people that call them are A-holes. Try to dealing with that day in and day out and see how friendly you are after a while.

    Secondly they are a debt collection entity. Just like any other debt collection entity it's not there job to care but to collect money owed and balance the books out. A lot of the times they will work with you if you are nice. But just like when a police man stops you, if you are rude get ready for a vehicle search.
