    It appears that McCain faces a similar situation.

    No he does not. The same questions were raised about him in 2000 and he was declared a natural born citizen by an act of Congress, not that there was ever any doubt anyway.

    We have two legal candidates.

    End of story.

    Not sure what you mean there.

    I was quoting the U.S. Constitution, which I suppose is 1787 law and trumps anything else.

    Obama is a legal citizen of the United States.

    Now if my wife were running for President, that might be another story. She was born in the exact same hospital as Obama but in 1955. Bummer, and I really wanted to be First Gentleman.

    According to Article 2 of the Constitution the President must be (1) a natural born citizen of the United States, (2) at least 35 years old, and (3) a resident of the United States for 14 years.

    If, at the time of your birth, both your parents were U.S. citizens and at least one had a prior residence in the United States, you automatically acquired U.S. citizenship with no conditions for retaining it.

    If only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16. There are no conditions placed on retaining this type of citizenship. If your one U.S. citizen parent is your father and you were born outside of marriage, the same rules apply if your father legally legitimated you before your 21st birthday and you were unmarried at the time. If legitimation occurred after November 14, 1986, your father must have established paternity prior to your 18th birthday, either by acknowledgment or by court order, and must have stated in writing that he would support you financially until your 18th birthday.

    The above is from the "Find Law" link previously posted. If this link is true, and these laws clarified the constitution regarding what a natural born citizen is, then Obama was not a "natural born citizen" according to the laws at the time.

    In the case of United States v. Wong Kim Ark, 169 U.S. 649 (1898) , the Supreme Court ruled that a person who

    • is born in the United States
    • of parents who, at the time of his birth, are subjects of a foreign power
    • whose parents have a permanent domicile and residence in the United States
    • whose parents are there carrying on business and are not employed in any diplomatic or official capacity of the foreign power to which they are subject

    becomes, at the time of his birth, a citizen of the United States, by virtue of the first clause of the 14th amendment of the Constitution

    The Constitution trumps state and federal law.

    Obama is a U.S. citizen and eligible to run for President.
