I'm not counting on it Rob. My statement is based on what one of my professors has said. There are a lot of differences between circuits, and one in particular has generous cases. Your analysis of paying student loans being a hardship misses the mark. The hardship analysis centers on you, not what the debt is. And guess what, you know slightly less than nothing about my situation or position.

And no matter your status at law school, you aint no attorney.

Actually mam, I am. I am a practicing student attorney. I currently have 4 clients and just took another immigration appeals case on today.

Oh, so you passed the bar exam? Awesome!

If you haven't passed your exam, then you are just a glorified paralegal--no disrespect intended.

Paralegals can practice law under the guidance of a licensed attorney just like certified "student attorneys"--except they probably make more money than the student.

True. But since I work as a paralegal for an attorney who has been practicing bankruptcy since 1963, I have a pretty good idea what is going on since reform. And according to the attorney I work for (I asked him), if you are able to get a job in your field, and the school you attended hasn't closed, and you do not have a mental or physical handicap, your chances of getting your school loans discharged in bankruptcy are slim although there may be another way besides bankruptcy to have your loans forgiven. Does this professor you consulted practice bankruptcy?

My firm has hundreds of clients and has represented thousands over the years. Congrats on your 4 immigration clients. I wish you continued success.

Smart man. I didn't disagree with him.

And furthermore, I'm sure both he and you know 8th circuit cases well. Specifically, however, I'm talking about the 9th circuit. Mind you, I don't plan on bankruptcy, I am just throwing out hypotheticals. I do need to go and see my professor again and get some specifics. She practiced in general law for years, and has in fact written a recent textbook on contract law.

Her words were (and she mentioned this in more than one class), "if you want to try and get your student loans discharged through bankruptcy, come and see me because I know how to do it. You'll have to hotfoot it out to Las Vegas because I don't think this position will last long without being reversed."

I finally mounted a small cctv cam under the rim of the seat and have it hooked up to my security monitor so that family and guests can observe the entire process from extrusion to paper work. I hate to brag but when I leave the bathroom I am often greeted by applause. Those who have observed this function are awarded the informal title of a "Jadooky Witness".

I think "try and get" is the key phrase here. It seems to me you would have to be a Nevada citizen in order to file for bankruptcy in the Nevada District.

Just in case you have more time than I do this weekend, here is the home page for the United States Bankruptcy Court, District of Nevada. Maybe it has something about student loan discharge on it:

I am very excited for you that you have 4-5 clients. You are on your way.

Naturally. It would be forum shopping for sure.
