In a court of law this is called speculation and is inadmissible as evidence. The instant anyone tries to say that, the judge will step in and have it stricken from the record.
Remaining silent in NO WAY harms you in a court of law.
When the police say "anything you say can and WILL be used against you..." they are not lying! The police WILL use everything you say against you while at the same time it is illegal for the police to use any of your statements to show you are innocent.
When you are talking to the police, nothing you say will help you, but it will certainly hurt you.
