    Yeah, that was the question that IA and I were talking about earlier that led to this. I mentioned that someone we both knew was DF'ed and lost his job and the question came up as to whether or not he could be file a complaint for being discharged for religious choices. If you want back in, I suggest the DF person not pursue that course. If you are like me and don't give a shit (not that I have or ever would work for witnesses), then go for it.

    I think some of you are missing the point. Filing a claim for unemployment (at least in NJ) is not charging the employer with anything. But it would force the employer to commit to a story one way or the other, even if he lies and trumps up something. You are entitled to recieve benifits even if you're fired, after a few weeks.

    Correct Deputy, the employer (at least in NJ) has to fill out a form detailing the wages paid and reason for dismissal. I highly doubt a JW would write that he is firing the employee for being Dfed, or separation from religion.

    But DD, is unemployment entitled to know the truth- if it makes the org look bad? Thus the WT definition of lying.

    Most likely, as others said, the JW employer would be told to not fire the person for being DF but to find another reason. This scenario would occur though if a hardline JW decided to ignore that advice.

    Perhaps some smart JW Employers would look at the conduct of the DF'd, things like: Does he attend all the meetings immediately after the anouncement(including the DF meeting), did he display full signs of repentance, does he hang his head in shame whenever he sees other JW's?

    They would maybe even be in touch with the JC to try and speed up the reinstatement, all this in trying to avoid being implicated in a Labour dispute should the DF'd decide to sue.

    Just because it is illegal to fire someone for religious reasons doesn't mean the witlesses will abide by the law. They also break the law by breaching confidentiality in many cases (like the blood issue), by harboring pedophiles and silencing the victims, and by hiding evidence within congregations that one of their members may have killed a baby (or eaten parts of it). If they can do these things, they can and will fire you for religious reasons and then use your filing a lawsuit or seeking unemployment (which could trigger an investigation) against your reinstatement at will.

    It sure would make interesting case law if the employee were allowed to enter the DF and " theocratic warfare strategy" into the case.

    We had the opposite if you like.

    A prominent elder , who "employed" (on a self-employed basis for tax purposes) a large number from a number of Congos. was DF'd and, almost to a man the JW's walked off the job, leaving the DF'd guy with no way of fulfilling his contracts, it seemed.

    A worldly guy who was doing a bit of work for him at the time saved him from bankruptcy by finding skilled workers that he knew to get the work done.

    This "worldly" guy thinks the JW's are bastards for doing what they did, even though he does not approve of what the Elder did that got him DF'd (Adultery)

    All in all much more reproach has been brought on the Congo. by the actions of self-righteous JW's. than if they had finished what they were contracted to do.

    Ok, let me ask something different- If a JW employee is Dfed and subsequently fired, and files a wrongful discharge suit against their former employer...would that lawsuit (obviously not making the org look good) get in the way of the person's reinstatement?

    Well, evidently df'd jws can be sued by jws....because they are no longer a brother or sister.

    But if the df'd individual wants to get back in....how would a jw suing another jw be viewed? Not favorably. So I would think if it matters if a jw sues a jw, it would matter if a df'd jw wanting to get back in were to sue a jw.
